医疗器械大案 县医院被罚1700余万元！

                    <p>医药网1月20日讯　1月18日，河北省药监局通报了2016年度该省食药案件查处和投诉举报情况。其中有一起医疗器械领域的大案，一家县级医院因为使用未经注册的一款医疗器械，而被罚款1700余万元。</p><p>&nbsp;</p><p><strong>　　该起案件详情如下：</strong></p><p>&nbsp;</p><p><strong>　　临漳县妇幼保健院使用未经注册的医疗器械案</strong></p><p>&nbsp;</p><p>　　2016年8月1日，临漳县食品药品监督管理局根据群众举报，对临漳县妇幼保健院执法检查。经查，该医院使用的“GE”牌Voluson E6超声诊断仪当场未能提供该机器的有效合格证明文件。</p><p>&nbsp;</p><p>　　2016年9月8日，上海市浦东新区市场监督管理局复函显示，临漳县妇幼保健院的“GE”牌Voluson E6超声诊断仪，机器铭牌信息系伪造，该超声诊断仪不是合法进口销售的医疗器械。</p><p>&nbsp;</p><p>　　临漳县食品药品监督管理局依法对临漳县妇幼保健院使用未经注册的医疗器械作出1、没收“GE”牌Voluson E6超声诊断仪；2、处以罚款1765.4万元的行政处罚。</p><p>&nbsp;</p><p>　　从通报来看，药监部门对医院违法行为的定性是“使用未经注册的医疗器械”。</p><p>&nbsp;</p><p>　　依据《医疗器械使用质量监督管理办法》，医疗器械使用单位存在“使用无合格证明文件、过期、失效、淘汰的医疗器械，或者使用未依法注册的医疗器械”行为的，由县级以上药监部门按照《医疗器械监督管理条例》第六十六条的规定予以处罚。处罚<strong><span style="color: rgb(0, 153, 102);">标准</span></strong>是没收违法使用的医疗器械，并且货值金额1万元以上的，处以货值金额5倍至10倍罚款。</p><p>&nbsp;</p><p>　　在该起案件中，5-10倍的处罚作用到本就昂贵的涉案医疗器械上，也就有了高达1700多万元的罚金，而这对一家县级妇幼保健院来说，堪称巨额了。</p><p>&nbsp;</p><p>　　对医疗器械<strong><span style="color: rgb(0, 153, 102);">企业</span></strong>们来说，这起案件的意义在于，这是《医疗器械使用质量监督管理办法》自2016年2月1日起施行以来的一起典型大案。因为该办法，2016年度，各地药监部门针对医疗机构使用医疗器械情况的监督检查大增，甚至启动了飞行检查。于是，在各地的通报中，也常见医疗机构使用医疗器械不当而被行政处罚。河北的这一起则因罚金太高而格外凸显了。</p><p>&nbsp;</p><p>　　另外，值得注意的是，从河北省药监局通报措辞来看，该涉案<strong><span style="color: rgb(0, 153, 102);">医院</span></strong>是被“群众举报”了。</p><p>&nbsp;</p><p>　　近年来，从国家到地方药监局，纷纷出台新规，重奖食药违法违规行为举报者，奖金通常最高可达30万元，部分地区甚至高达60万元。重奖之下，“勇夫”亦在增多。</p><p>&nbsp;</p><p>　　以河北省药监局在2016年度立案查处的<strong><span style="color: rgb(0, 153, 102);">药品</span><span style="color: rgb(0, 153, 102);">医疗器械</span></strong>方面案件为例，一共5起典型大案（案值金额均在百万元以上），假药案4起，医疗器械案件1起，而其中3起假药案和如上所述的1起医疗器械案件，均是根据举报展开查处工作的。</p><p>&nbsp;</p><p>　　依据通报，2016年，河北全省共接收食药领域投诉举报信息45431件，较2015年增长26%。其中，兑付某药品案件举报奖励18万元，创下该省投诉举报中心成立以来单笔奖励金额记录。</p><p>&nbsp;</p><p>　　此外，依据通报，2016年，河北省共立案查处各类食药违法违规案件18674起，是2015年的111%；行政处罚金额12353.37万元，是2015年的249%。药监局查处力度增幅惊人。</p><p>&nbsp;</p><p>　　监管环境在变得更为严格，对于医疗器械生产、销售和使用单位来说，也愈加需要合规经营。赚钱不易，若是一不小心被罚个损失惨重、血本无归...那可真是哭都没地方可哭了！</p><p><br  /></p><p style="text-indent: 0em;
