<p>医药网1月23日讯 2016年底的央视曝光药品回扣事件，余波未消；又有个别地方在“封杀”医药代表后再升级，变成了不准医生参加药械企业提供的学术研讨会了，也即“封杀”企业邀请参加学术会议！</p><p> </p><p> 国家卫计委日前印发的2017年工作要点中，医疗反腐也赫然在列；</p><p> </p><p> 2017年全国医疗管理工作会议1月16日在北京召开，国家卫计委副主任、国务院医改办主任王贺胜称，要开展用药和医用高值耗材专项整治活动，对医药购销领域商业贿赂行为“零容忍”，对存在回扣等行为的涉案人员，依法依规严肃处理，绝不姑息，对涉案的生产流通企业，依法依规严惩不贷。</p><p> </p><p> 2017，医疗反腐不会缺席，而有些地方早已先行一步，有的甚至整治时间长、查的范围也“广”。</p><p> </p><p> 比如河南省郑州市，要在全市医院集中整风5个月，查处内容则除了回扣、商业统方，还有大处方、滥检查、科室外包、乱收费、违规加成等。</p><p> </p><p> 值得注意的是，郑州市卫计委明确提出，禁止医院和医生参与医药企业提供的参观、考察和会议研讨交流等活动。</p><p> </p><p> 据郑州市卫计委消息，为进一步治理医疗领域的商业贿赂行为、净化医药流通领域的生态环境，该委决定在全系统各医疗单位集中进行行风整治活动，实施方案已于2017年1月18日印发。</p><p> </p><p> 整风活动为期5个月，提出“六个严禁”要求，其中治疗<strong><span style="color: rgb(0, 153, 102);">药品</span></strong>回扣为重点。</p><p> </p><p><strong> </strong><strong>“六个严禁”包括：</strong></p><p> </p><p> 1、严禁医务人员参与<strong><span style="color: rgb(0, 153, 102);">医药</span></strong>产品、器械、<strong><span style="color: rgb(0, 153, 102);">保健品</span></strong>等商品推销活动，各科室及医务人员不得利用执业之便收受药品生产、经营<strong><span style="color: rgb(0, 153, 102);">企业</span></strong>或经销人员以各种名义给予的财物、回扣、提成或其他好处（如：资助参观、旅游、考察、会议研讨交流等）。</p><p> </p><p> 2、严禁医院工作人员违反诊疗用药原则开“大处方”、滥检查、重复用药等，不得在诊疗活动中告知患者到院外指定地点购买医药产品、器械、保健品等商品。</p><p> </p><p> 3、严禁医疗卫生人利用任何途径和方式为商业目的统计医师个人及临床科室有关药品、医用耗材的用量信息，或为医药营销人员统计提供便利。</p><p> </p><p> 4、严禁违反规定外出会诊手术。医师外出会诊手术必须遵守相关规定，不得在不具备相应资质的医疗机构开展择期手术，收受或者索要患者及其家属的钱物。</p><p> </p><p> 5、严禁医疗机构发布虚假医疗广告、有偿转诊、科室出租承包，将医疗服务收入直接与个人收入挂钩。</p><p> </p><p> 6、严禁医疗机构不严格执行国家物价政策，自立项目收费、分解收费、重复计费、违规加成出售药品等行为。</p><p> </p><p> 与湖南省的“五不准”、上海市的“十不得”、国家版本的“九不准”等相比，郑州市的医疗行风整治内容大同小异。最为特殊的就是，把医药企业赞助的学术等会议也给明确禁止了。</p><p> </p><p> “九不准”一共九条，其中之一是“不准收受回扣”。精确表述为：“严禁利用执业之便谋取不正当利益，严禁接受药品、<strong><span style="color: rgb(0, 153, 102);">医疗器械</span></strong>、医用卫生材料等医药产品生产、经营企业或经销人员以各种名义、形式给予的回扣，严禁参加其安排、组织或支付费用的营业性娱乐场所的娱乐活动。”</p><p> </p><p> 另外，还有一个单独的“不准开单提成”，也即：“严禁医疗卫生机构在药品处方、医学检查等医疗服务中实行开单提成的做法，严禁医疗卫生人员通过介绍患者到其他单位检查、治疗或购买医药产品等收取提成。”</p><p> </p><p> 而郑州市卫计委的第一个严禁中，禁止了回扣、提成，也禁止医生收受其他好处。这些被列举出来的好处包括：资助参观、旅游、考察、会议研讨交流等。学术会议作为会议研讨交流的一种，自然也应算在禁止之列。</p><p> </p><p> 一直以来，对医药企业赞助的学术会议，是存在一定争议的。比如，钟南山院士就表示，“药企资助学术会议是天经地义的。就拿夺得游泳世锦赛3枚金牌的孙杨来说，他只有参加高水平的国际比赛，与强有力的对手竞争才能出好成绩。同样，中国医学水平的提高也是需要交流的，不可能闭关自守。”</p><p> </p><p> 不过，实践当中，过去也曾有医药企业因向医生支付讲课费而被处罚的案例。在经历了2013年的葛兰素史克事件后，部分跨国医药企业更是直接叫停了向医生支付讲课费，以绝后患。</p><p> </p><p> 不管争议如何，至少在未来一段时间里，郑州市的医生们是要对医药企业或医药代表赞助的学术会议、考察等“说不”了，医械企业们莫越雷池！</p><p><br /></p><p style="text-indent: 0em;
