                    <section data-role="paragraph" data-color="rgb(182, 228, 253)" data-custom="rgb(182, 228, 253)"><section><section><section><section powered-by="gulangu"><section><section><section><section powered-by="gulangu"><section><section><section><section powered-by="gulangu"><section><section><section><section powered-by="gulangu"><section><section><section><section><p><p><img src="image/20201014/86b79d371e9862b01189f0252a03b2cd_1.png" /></p></p></section><section><section><span><strong></strong></span></section><p><span>医疗器械媒体报道先锋</span></p><p><span>分享专业医疗器械知识</span></p></section><section><section><section><span>关注</span></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section></section><section powered-by="gulangu"></section><p><br  /></p><p><span>来源：</span><span>摩根路易斯律师事务所</span></p><p><br  /></p><section powered-by="gulangu"><p><span>从扰乱医疗器械的供应，到影响医疗器械在英国的监管和销售，脱欧可能对英国的医疗和贸易产生重大影响。</span><span>本文主要介绍(i)英国脱欧对医疗器械市场的影响，(ii)英国（作为欧盟成员国）和欧盟其他成员国现行医疗器械监管体系的一些关键特征，(iii)无协议脱欧将如何影响英国和欧盟的医疗器械销售，以及(iv)英国和欧盟在脱欧后如何进行合作。</span></p><p><br  /></p></section><section powered-by="gulangu"><section><section><section><section></section></section></section><section><p><strong>一、脱欧和医疗器械市场</strong></p></section><section><section></section><section></section></section></section></section><section powered-by="gulangu"><p><span><br  /></span></p><p><span>截至目前，英国脱欧的协议条款和日期仍然不确定。英国脱欧可能会中断往来于英国与欧盟间的各种商品和服务的供应，这尤其会对药品和医疗器械的供应产生影响。</span></p><p><br  /></p><p><span>除了对药品供应产生影响外，英国脱欧还将对英国医疗器械的监管和贸易模式产生长期影响，甚至对英国的医疗健康行业和贸易带来潜在的问题。有关英国脱欧对医疗器械监管和贸易可能产生的关键问题包括：(i)脱欧后，由位于英国的公告机构（Notified Body）批准的医疗器械需要新的“CE”（Conformité Européene）标志方可投放欧盟市场；(ii)经欧盟批准的医疗器械，需要同时在英国的公告机构注册，方可投放英国市场；以及(iii)英国医疗器械监管机构将无法再访问其他欧盟成员国医疗器械监管机构共享的医疗器械上市后的安全数据。</span></p><p><br  /></p></section><section powered-by="gulangu"><section><section><section><section></section></section></section><section><p><strong>二、英国现行的医疗器械监管体系</strong></p></section><section><section></section><section></section></section></section></section><section powered-by="gulangu"><p><br  /></p><p><span>在英国，药品和保健产品监管局（“MHRA”）全面负责许可和监管医疗器械。目前，医疗器械和体外诊断设备必须满足欧盟医疗器械指令（“指令”）的基本要求。经认证的符合指令要求的医疗器械均标有“CE”标志，可以在欧盟和欧洲经济区内任何地方上市和销售。</span></p><p><br  /></p><p><span>根据指令规定，虽然低风险器械制造商可以通过《符合性申明书》（Declaration of Conformity）进行自我认证，但高风险器械（第二类和第三类医疗器械和某些体外诊断设备）必须通过独立的公告机构进行评定和认证。</span></p><p><span><br  /></span></p><p><span>两项新的欧盟法规，即医疗器械规定（Medical Devices Regulation）以及体外诊断规定（In Vitro Diagnostics Regulation）将分别于2020年5月和2022年5月前实行。同时，英国政府也计划实施一个尽可能反映新法规的体系。</span></p><p><br  /></p></section><section powered-by="gulangu"><section><section><section><section></section></section></section><section><p><strong>三、无协议脱欧对医疗器械销售的影响</strong></p></section><section><section></section><section></section></section></section></section><section powered-by="gulangu"><p><br  /></p><p><span>在无协议脱欧的情况下，英国不能继续参与欧盟共同的监管体系。例如，位于英国的公告机构不能够继续评估医疗器械的合规性，并授予其“CE”标志，进而允许他们进入欧盟市场。MHRA将无法通过欧盟监管体系进行医疗器械上市后监管，且无法再访问其他欧盟成员国医疗器械监管机构共享的医疗器械上市后的安全数据。</span></p><p><br  /></p><p><span>除了欧盟的平行注册要求，所有医疗器械在进入英国市场之前都需要在MHRA进行注册。英国政府规定了一定的宽限期（从4到12个月不等，具体取决于医疗器械的分类），从而给予一定的时间遵守新的注册程序。</span></p><p><br  /></p><p><span>对于位于英国境外的医疗器械的生产商而言，其应由在英国成立、具有英国注册地址并对产品在英国境内承担责任的“英国负责人”（UK responsible Person）在英国向MHRA注册医疗器械。但是，英国政府将不会要求对受影响的医疗器械产品的标签进行任何更改，将继续接受英文标签，前提是标签信息要符合英国的所有要求。英国政府还表示，在未来有限的一段时间内，将继续承认医疗器械上的“CE”标志，并允许此类器械继续投放英国市场，但前提是其符合欧盟的所有要求。</span></p><p><br  /></p></section><section powered-by="gulangu"><section><section><section><section></section></section></section><section><p><strong>四、脱欧后的合作选择</strong></p></section><section><section></section><section></section></section></section></section><section powered-by="gulangu"><p><br  /></p><p><span>英国政府与欧盟委员会达成的脱欧协议规定，在2020年12月底之前的过渡期内（有可能再延长两年），将继续适用欧盟法律且欧盟法院对英国享有管辖权。在过渡期内，英国和欧盟将会达成更长远的安排，如英国和欧盟未来关系的政治宣言（“政治宣言”），其中英国和欧盟之间的医疗器械将继续自由流动。过渡期之后，英国和欧盟也将探讨英国当局和欧洲药品管理局等欧盟机构合作的可能性。</span></p><p><br  /></p><p><span>由于脱欧协议和政治宣言尚待英国议会的批准，目前监管前景并不明确。脱欧之后，英国的医疗器械监管有两种可能结果：一种是英国仍留在欧盟监管体系内，另一种则是MHRA成为独立的监管机构。如果是第二种结果，即MHRA成为独立的监管机构，则可能还会出现重大的监管调整，例如通过一项英国 -
