回扣10万起步，彩超利润超50％：西门子、飞利浦、GE医疗行贿细节曝光

/></p></p><section><br  /></section><section><span>这是国家医保局出台《关于建立医药价格和招采信用评价制度的指导意见》后的配套机制之一，药企的“失信行为”，主要评价依据就是商业贿赂被刑事立案和审判。最高法及时向国家医保局通报案件信息，将加速信用评级制度的落地。</span></section><section><span><br  /></span></section><section><span>药品领域的不当空间已经被越压越小，但在医院采购量很大的医疗设备上，现有的监管措施却很难渗透。</span></section><section><span><br  /></span></section><section><span>近日，青海省第五人民医院院长柴多的判决书被公开。柴多从2013年4月开始任青海省五院的院长，直到2019年8月因严重违规违纪接受调查。经法院审理查明，柴多受贿金额共计562.4万元。</span></section><section><span><br  /></span></section><p><p><img src="image/20201014/cb32b7d35c2b22a53889e15be64b9105_3.jpg" /></p></p><section><span>在被查明的受贿事实中，除了医院基建工程上收受贿赂外，柴多主要就在医院的医疗设备采购中拿好处。给柴多送钱的是飞利浦和西门子两家医疗设备巨头。</span></section><section><span><br  /></span></section><section><span>而翻看近两年的案例，就能发现这两家外企，以及并称“GPS”之一的通用医疗，屡屡充当行贿者的不光彩角色。</span></section><section><span><br  /></span></section><section><span><strong><span>柴多最早在2008年就收过飞利浦的钱。</span></strong></span></section><section><span><br  /></span></section><section><span>2008年10月，柴多时任西宁市第一人民医院院长，医院采购了一家陕西企业代理销售的飞利浦彩超机。为了尽快回款，该企业给柴多送了10万元现金。</span></section><section><span><br  /></span></section><section><span>6年过后，柴多已到了青海省五院任院长。当时五院也采购了一台飞利浦的彩超仪，代理公司的老板就是此前在陕西开公司的刘某，这次他同样给柴多送了10万元。</span></section><section><span><br  /></span></section><section><span>医院采购这些高额设备要经过立项、报批、招标等环节，看似堵住了贿赂的漏洞，实际上企业还是有很大的空间。</span></section><section><span><br  /></span></section><p><p><img /></p></p><section><span>（飞利浦某款彩超仪）</span></section><section><span><br  /></span></section><section><span>柴多仅仅是帮助代理企业加速回款，就能拿到10万元的回扣。那么一台彩超仪的实际利润到底有多大？2019年9月份披露的一起行贿案件里有详细介绍。</span></section><section><span><br  /></span></section><section><span>重庆市南川市人民医院院长李剑平2017年3月因违纪接受调查，他也是在采购飞利浦彩超仪上马失前蹄的。</span></section><section><span><br  /></span></section><section><span>2013年，南川市人民医院采购两台飞利浦彩超仪，飞利浦的代理商以476万元的价格中标。事后，盖子被揭开，2台飞利浦彩超，代理商拿到的利润是：</span></section><section><span><br  /></span></section><section><span>175万元！</span></section><section><span><br  /></span></section><section><span>因此当李剑平说想要“借钱”时，代理商二话没说，直接向李院长的卡上转了60万。</span></section><section><span><br  /></span></section><section><span>当然，比起烟台市莱山区第一人民医院院长郭军来说，柴多拿的钱还算是多的。今年6月披露的案例显示：2007-2013年期间，郭军所在的医院三次采购飞利浦彩超仪3台，郭军总计从飞利浦代理商处收受回扣20万元。</span></section><section><span><br  /></span></section><section><span>不难发现，在飞利浦医疗设备的贿赂案件中，代理商冲在了第一线，很少见飞利浦员工的身影。出事之后，飞利浦大可以一推了之。</span></section><section><span><br  /></span></section><section><span>医保局的“信用评价”制度里，为了避免药企利用代理商、临时工等规避责任，明确指出整个经销链条上只要发生商业贿赂，板子就打到生产企业上。只可惜，医疗设备领域这些制度还是空白的。</span></section><section><br  /></section><section><span><strong><span>比起谨慎的飞利浦来说，近年来业绩稍稍落后的西门子胆子就大得多。</span></strong></span></section><section><span><br  /></span></section><section><span>上面提到的柴多，收的另一笔主要贿赂款就来自西门子，这是笔长线投资。</span></section><section><span><br  /></span></section><section><span>2014年11月，西门子的代理商邀请柴多去参观珠海航展，期间送给他30万元。2018年，柴多在医院采购设备时暗中操作，顺利让西门子牙椅中标。</span></section><section><span><br  /></span></section><section><span>不仅如此，据青海省五院口腔科副主任称：自那以后，医院口腔科凡是要新进设备，一律都是西门子的。</span></section><section><span><br  /></span></section><p><p><img /></p></p><section><span>（5年前的乌龙事件，但其指向的问题确实存在）</span></section><section><span><br  /></span></section><section><span>但在另外一些案例中，西门子的工作人员则是直接出面成为行贿者。</span></section><section><span><br  /></span></section><section><span>在今年1月披露的黄石市普爱医院副院长王芳受贿案中，西门子武汉分公司销售总监仇某就亲自给王院长送了20万元，以答谢她在采收设备时的帮助。</span></section><section><span><br  /></span></section><section><span>不仅如此，仇总还向鄂东医疗集团总院院长张杰送过20万元，并通过张杰认识了黄石市中心医院保障部主任，王主任在收下10万元后，帮助西门子在2015年黄石中心医院的数字减影项目中顺利中标。</span></section><section><span><br  /></span></section><section><span>西门子的工作人员也曾为代理商的行贿行为背书。今年9月披露的亳州市人民医院院长杜运志一案中，西门子的代理商直接领着西门子皖北片区业务经理安某去和杜院长见面，三方谈妥：</span></section><section><span><br  /></span></section><section><span>“如果西门子产品中标，由代理商向杜运志支付200万元好处费。”</span></section><section><span><br  /></span></section><section><span><strong><span>GE医疗也并非善类。</span></strong></span></section><section><span><br  /></span></section><section><span>在今年7月份披露的眉山市人民医院院长王建民受贿案、禹城市人民医院院长麻元受贿案中，GE医疗出手更大方。在眉山王建民一案中，GE给代理商的推广费用是产品实际价格的210%，代理商甚至用这笔钱为王建民在成都买了一套房！</span></section><section><span><br  /></span></section><section><span>GE、飞利浦、西门子三家企业首字母排在一起被并称为“GPS”。三巨头几乎垄断了国内高端医疗设备市场，业界一直称至少占据市场80%以上。有机构对2017年国内市场份额做了统计，几大品类的市场占有率结果如下：</span></section><section><span><br  /></span></section><p><p><img
