/></p><p><span>2020年5月26日，据国家药监局官网消息，国家药品监督管理局局长焦红在全国政协十三届三次会议上建议，加强药品医疗器械应急管理体系建设，完善重大疫情防控体制机制，加快推进职业化专业化检查员、审评员队伍建设等。</span></p><p><br  /></p><p><p><img src="image/20201014/caa6c69af9fa7ef3bafe22a5bd98297d_2.jpg" /></p></p><p><br  /></p><p><span>5月21日，广东药监局公布部分检查员考核合格消息，据赛柏蓝器械观察，目前多省已经成立职业化医疗器械检查队伍，江西、陕西、河北、山东、浙江、上海等等。</span></p><p><br  /></p><h2><span>这意味着，在医疗器械检查中，最专业的检查员要来了，国务院此前发布《关于建立职业化专业化药品药品检查员队伍的意见》。</span></h2><p><br  /></p><p><span>文件强调，职业化专业化医疗器械检查员是指经药品监管部门认定，依法对管理相对人从事药品研制、生产等场所、活动进行合规确认和风险研判的人员。</span></p><p><br  /></p><p><span>文件规定，在检查体制和机制上，将分为国家级和省级两个检查员队伍，配备满足检查工作要求的专职检查员。<br  /></span></p><p><br  /></p><p><span>具体来看，国务院监管部门主要医疗器械研发过程现场检查，会从医疗器械临床试验质量管理规范执行情况合规性检查。承担医疗器械境外现场检查以及生产环节重大有因检查。</span></p><p><span> </span></p><p><span>而省级药品监管部门主要医疗器械生产过程的现场检查，以及有关生产质量管理规范执行情况合规性检查。</span></p><p><br  /></p><p><span>省级部门还将对医疗器械批发企业、零售连锁总部、互联网销售第三方平台也将进行相关现场检查。可以看出国家针对医疗器械领域的各个环节，各个渠道都做了部署。</span></p><p><br  /></p><section><section><section><section><section><section><br  /></section><section><br /></p><p><span>开年以来，国家、多省药监部门发布“医疗器械飞行检查管理办法”，抽检、飞行检查一直在进行。</span></p><p><br  /></p><p><span>5月22日，国家药品监督管理局对部分医疗器械质量监督进行抽检，共24批（台）产品不符合标准规定。</span></p><p><br  /></p><p><p><img src="image/20201014/c96af4cf6caa1d7f33620bd253f8eb55_3.png" /></p></p><p><span> </span></p><p><span>一个事实是，企业无完美，不可能无疏漏，所以国家加大力度检查是为了使医疗行业的生产与流通往更加健康的方向发展。</span></p><p><br  /></p><p><span>而以不发通知、不打招呼、直插企业的方式是最能看到真实情况的方法之一。暗访是这种方式，飞行检查也同样是。</span></p><p><span> </span></p><p><span>对于飞检，是主要关注企业的生产质量管理体系，专业检查组不远千里来到企业的目的就在于指出问题，督促企业生产质量管理体系进行持续改进。</span></p><p><span> </span></p><p><span>对于暗访，湖北省药监局曾发布《省局开展全省药品安全暗访调研》的通知，派出5个暗访组，对企业、医疗服务机构、基层监管机构进行调研，涉及范围包括医疗器械领域。</span></p><p><span> </span></p><p><span>在检查方式上，暗访将采取事先不发通知、不打招呼、不听汇报、不用陪同接待、直奔基层、直插现场的方式，查找企业存在的突出问题及薄弱环节。</span></p><p><br /></p><p><span>近日，国家医保局发布了行政执法事项清单（2020年版），其中提到将对高值医用耗材进行检查。</span></p><p><br  /></p><p><span>对于企业以及广大经销商、医疗机构，在检查机构没到来之前，自查整改是现在最应该做的事，自查整改哪些经营行为是重点？<br  /></span></p><p><br  /></p><p><span>1.为他人违法经营医疗器械提供场所、资质证明文件、票据。</span></p><p><span>2.从个人或者无证单位购进医疗器械。</span></p><p><span>3向无合法资质的单位或者个人销售医疗器械。</span></p><p><span>4.伪造器械采购来源。</span></p><p><span>5.虚构医疗器械销售流向。</span></p><p><span>6.篡改计算机系统与监测系统，隐瞒真实医疗器械购销记录、票据、凭证、数据。</span></p><p><span>7.医疗器械购销存在记录不完整、不真实，且经营行为无法追溯。</span></p><p><span>8.购销医疗器械时，许可证书、发票、随货同行票据、实物账、财务账、器械实物、货款不能相互对应一致。</span></p><p><span>9.医疗器械未入库，设立账外账，且未纳入企业质量体系管理。</span></p><p><span>10.在核准地址以外的场所储存医疗器械。</span></p><p><span>11.未按规定对医疗器械进行运输。</span></p><p><span>12.擅自改变注册地址、经营方式、经营范围。</span></p><p><br  /></p><p><span>在检查中，若企业检查出情节严重的违规违法行为，一律吊销经营许可证，并向社会公开。对涉嫌犯罪的，移交公安机关部门。</span></p><p><br  /><span>同时对企业法定代表人和主要负责人依法纳入黑名单管理，并向社会公布其姓名和身份信息；按规定向有关部门通报，实施联合惩戒。</span></p><p><br  /><span>从过往的案例看，对待违规企业的过票、虚开发票、无证经营等违法行为的处罚，税务总局和公安机关绝不手软。涉案企业被严厉追责，追究刑事责任。</span></p><p><span> <br  /></span></p><p><span>无论是飞行检查还是暗访，都是对不过关的械企实行惩戒，下达“整改令”，从源头上控制“污点”企业产品的外流，企业如果想做到“来检不惊”，必须在自身生产与管理上严格执行相关规定。</span></p><p><br  /></p><section data-bgless="spin"
