/></p></section><section><span>《公告》表示，瑞安市人民医院与瑞安市妇幼保健院对检验科试剂、检验科设备进行招标采购与租赁。</span></section><p><br  /></p><section><p><img src="image/20200927/fc33c7823b7394ff5b0916d7439b16f8_3.png" /></p></section><p><br  /></p><section><span><strong>此次项目的预算为3.07亿元，服务周期设定为5年。试剂耗材允许进口投标。</strong></span></section><p><br  /></p><section><span>颇有亮点的是，此次瑞安市人民医院与瑞安市妇幼保健院进对检验科设备进行了公开租赁。</span></section><section /></p><br  /></section><section><span>瑞安市人民医院（温州医科大学附属第三医院）是瑞安地区规模最大的集医疗、科研、教学、预防、保健、康复于一体的大型综合性医院，是浙江省卫生厅核准的综合性三级乙等医院。医院目前开放床位2008张，共设临床专业学科47个，病区54个，拥有35间洁净手术间和功能齐全的重症监护中心。</span></section><section><span>2018年医院业务总收入达22.46亿元，门急诊总诊疗人次399.8万人次，住院病人11.35万人次，住院手术3.94万例，承担着瑞安市160多万人口及周边平阳、苍南、文成、泰顺等地区的部分病员的医疗保健任务。&nbsp;</span></section><section><span><strong>瑞安市妇幼保健院</strong></span></section><section><span><p><img /></p></span></section><p><br  /></p><section><span>瑞安市妇幼保健是免费婚前医学检查和免费孕前优生健康检查定点单位，是全市“预防出生缺陷三项筛查”中心，承担全市妇女儿童保健工作的技术指导，是中国宫颈癌防治工程定点医院，是卫生部妇幼保健与社区卫生司新生儿健康促进合作项目基地。</span></section><p><br  /></p><section><span>医院总占地面积10056平方米，总建筑面积30000平方米，该院共开设11个临床专科、6个医技科室，9-20层为住院部，总设置床位350张，包括特需产区、普通产区、妇科、新生儿、MICU、NICU、乳腺外科和普儿病区。</span></section></section></section></section></section></section><p><br  /></p><section data-brushtype="text"><p><span>02</span></p></section></section><section><p><span><strong>三甲医院对IVD设备进行公开租赁？！究竟合不合法？</strong></span></p></section></section></section></section></section><p><br  /></p></section><section><span>此次《招标》文件中有一个特别的点，</span><span><strong><span>公开要求对检验科设备进行租赁，而并非采购。</span></strong></span><span></span></section><p><br  /></p><section><span>其实，早在去年9月 ，中山大学附属医院与莱芜市中医院对试剂耗材的招标采购文件上就明确表示对IVD设备进行公开租赁。</span></section><section></section><p><p><img src="image/20200927/f002ae4d048ab7871aea576f86ea6c66_6.jpg" /></p></p><p><p><img src="image/20200927/763192de2a7be67f5adc2cbea56381bf_7.jpg" /></p></p><section><span>这不禁想让阿晨酱疑问，IVD设备的租赁到底合不合法？目前来看，体外诊断设备的有三种销售模式：</span></section><p><br  /></p><section><span><strong><span>一、 直接销售模式，</span></strong>即由体外诊断产品厂家或者经销商将体外诊断产品直接销售给医院等医疗机构，医疗机构需要具有较强的资金实力购买价格较高的体外诊断仪器以及采购相应配套试剂；</span></section><p><br  /></p><section><span><strong><span>二、 融资租赁模式，</span></strong>指租赁公司以为医疗机构进行资金融通为由，根据医疗机构需要购买相应体外诊断仪器，再与医疗机构签订融资租赁合同将设备租赁给医疗机构使用，医疗机构按期支付固定租金的一种金融服务方式。</span></section><p><br  /></p><section><span><span><strong>三、医疗检验集约化营销及服务业务模式，</strong></span><strong><span>即体外诊断产品经营机构与医疗机构签订中长期业务合同，约定在合同期内，体外诊断产品经营机构向医疗机构提供体外诊断仪器供其使用，医疗机构向体外诊断产品经营机构采购体外诊断试剂和耗材。</span></strong></span></section><p><br  /></p><section><span>在中山大学附属肿瘤医院的IVD设备租赁及试剂采购招标中表示要租赁三台全自动血液细胞分析仪，最高限价十万元，租赁期三年；</span><span>同时全自动血液细胞分析仪配套试剂采购供货期也是三年。</span></section><p><br  /></p><section><span>这种模式的好处在于医院可以长期以较低价格，第一时间拿到供应商提供的产品，供应源头比较稳定；</span></section><p><br  /></p><section><span>对于中标企业来说，有了长期合作的买家，虽然单件产品的利润水平可能降低，但是收入相对稳定，一定程度上也可以规避市场上医疗器械产品价格大幅波动的风险。</span><span>只是这种“打包”模式和租赁模式碰撞到了一起，便必然存在风险！</span></section><p><br  /></p><section><p><img data-role="paragraph"><section><span>很明显，此次瑞安市人民医院与瑞安市妇幼保健院的IVD设备租赁属于体外诊断产品销售模式的第三条。直白来说，医疗机构检验科使用的设备是租的，试剂是买的。</span></section><p><br  /></p><section><span><span>其实，体外诊断设备的租赁都是法律认可的方式，只要按法定程序审批了就不算违法！</span><strong><span>法律惩罚的是假借租赁进行一些商业贿赂等的不正当竞争行为。</span></strong></span></section><p><br  /></p></section><section data-role="paragraph"><section><span>中国的体外诊断产业起步较晚，国外的体外诊断产品占据了中国市场70% -80% 的份额。医疗消费因经济和政策等因素限制，检验科开展的项目比较单一，检测的标本量也有限，从而形成了传统的商业模式：“租赁设备+购买试剂“等合作模式。</span></section><p><br  /></p><section data-tools="gulangu" data-id="93972"><section><section><section><section><section data-brushtype="text"><p><span>03</span></p></section></section><section><p><strong><span>近年来国家对假借租赁进行的违法行为也多有表示：</span></strong></p></section></section></section></section></section><p><br  /></p><section><span>2018年7月正医药购销领域和医疗服务中不正之风部际联席<strong><span>会议第二十次会议中市场总局重点强调“严肃查处假借租赁、捐赠、投放设备等形式，捆绑耗材和配套设备销售等涉嫌商业贿赂不正当竞争行为”</span></strong>，这是一次全国范围的医疗纠风会议。<br  /></span></section><section><span>8月30日，广西省卫计委发布的《全区公立医疗机构规范诊疗行为和违规采购专项整治工作方案》中明确规范医疗机构假借租赁、捐赠、投放设备等形式，捆绑耗材和配套设备销售等涉嫌商业贿赂不正当竞争行为。</span></section></section><p><br  /></p>
