box-sizing: border-box !important; width: auto !important; visibility: visible !important;" /></strong><img data-s="300,640" src="http://mmbiz.qpic.cn/mmbiz/A1DicCH9Vl6OSS40djTaFrNbMbYqk8yYpWOpPS6dlKPey7myNOmu5CiasknJbdiaGibK1ESbFIB0bjibVicuhhDyMq7Q/0" data-ratio="0.5652173913043478" data-w="" />近日，山东省聊城市中级人民法院一审对原莘县人民医院院长李书章贪污、受贿、巨额财产来源不明一案作出公开宣判，以李书章犯贪污罪，判处有期徒刑十四年，犯受贿罪，判处有期徒刑十一年，犯巨额财产来源不明罪，判处有期徒刑六年，决定执行有期徒刑二十年。</p><p style="">法院经审理查明，2010年至2013年2月，被告人李书章利用担任莘县人民医院院长的职务便利，采取虚构医疗设备维修、虚增医院内科病房楼工程量、虚报装修款、虚构出国考察需要资金证明等手段，骗取、侵吞公款共计人民币3049315元。</p><p style="">2005年至2013年，被告人李书章利用担任莘县人民医院院长的职务便利，单独或伙同其妻纪玉玲收受有关单位和个人款物共计人民币1154660元，并为他人在工作安排、人员调入、工程承揽、医疗器械采购等方面谋取利益。</p><p style="">被告人李书章家庭财产共计13458635.56元，各项家庭支出共计326879.7元，两项总计13785515.26元，扣除家庭合法收入1518263.4元、受贿犯罪所得1104660元、贪污犯罪所得2921915元，李书章对差额8240676.86元的财产不能说明来源。</p><p style="">法院审理认为，被告人李书章身为国家工作人员，利用职务便利，单独或伙同他人采取骗取、侵吞等手段，非法占有公共财物，其行为已构成贪污罪；利用职务便利，单独或伙同其妻非法收受他人财物，为他人谋取利益，其行为已构成受贿罪；对其家庭财产、支出明显超过合法收入的部分不能说明来源，其行为已构成巨额财产来源不明罪，且差额特别巨大。公诉机关指控李书章犯贪污罪、受贿罪、巨额财产来源不明罪的罪名成立。李书章一人犯数罪，依法应予并罚。在共同贪污和共同受贿中，被告人李书章起主要作用，系主犯，应依法惩处。鉴于其当庭供认大部分犯罪事实，认罪态度较好，且积极退赃，对其可从轻处罚。</p><p style="">根据被告人李书章犯罪的事实、性质、情节和对于社会的危害程度，法院遂依法作出判决：被告人李书章犯贪污罪，判处有期徒刑十四年；犯受贿罪，判处有期徒刑十一年；犯巨额财产来源不明罪，判处有期徒刑六年；决定执行有期徒刑二十年。对被告人李书章贪污所得、受贿所得和家庭财产不能说明来源差额部分非法所得共计12267251.86元及孳息，予以没收，上缴国库。一审宣判后，被告人李书章表示不上诉，现该判决已生效。</p><p><span style="">来源: 中国网<img src="http://mmbiz.qpic.cn/mmbiz/rz7R73cuHRrv6jdOCoJeZmYwvEAIoHpY0a7yJL2egiaEokLTpwkIsIRTzTFUic09aEThKHS4hrEcSqU0lAS3tu5g/0" data-ratio="0.14784394250513347" data-w="487" width="auto" width="auto" src="http://mmbiz.qpic.cn/mmbiz/rz7R73cuHRrv6jdOCoJeZmYwvEAIoHpY0a7yJL2egiaEokLTpwkIsIRTzTFUic09aEThKHS4hrEcSqU0lAS3tu5g/0" style="color: rgb(51, 51, 51);
