white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 骆汉生是湖北省人民医院的一名副主任技师，主要负责医疗器械维修与管理。以前，当这些医疗器械出问题时，骆汉生可以对照着随机附送的维修手册自行解决。但现在，他们只能花高价求助于厂家。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 消失的维修说明书背后，是一个巨大的市场。数据显示，进口医疗器械的维修利润是销售利润的三倍。骆汉生对记者说，他们医院有一份一台990万元的ct机的合同，每年保修费用高达140万元。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 多年来，骆汉生一直在为医疗设备反垄断的事奔波。因此，当得知首届中国医疗设备民族工业发展大会要讨论“打破中国医疗设备售后服务垄断坚冰”后，骆汉生不请自来，自费赶到了北京会场。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 11月8日这天，骆汉生在包里塞了一沓盖着自己印章的材料，在会场找了个位置坐下。参会嘉宾包括医院领导、本土医疗器械企业以及业内观察人士。嘉宾演讲时，骆汉生主动举手要求发言，因为激动，他的胳膊一直在颤抖。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> “这件事，整个中国的医疗机构是受害者，中国的老百姓更是最大的受害者。”骆汉生说。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 不提供技术说明书因为涉及专利秘密？</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 骆汉生回忆称，大概在2000年以前，供应商在向医院等用户交付进口医疗器械设备时，随机文件会附有技术说明书，说明书中有带有电路图纸的维修手册。但渐渐地，这些供应商在交货时不再提供这一关键的资料了。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 由于没有维修资料，中国的维修师无法自行对设备进行维护和修理。自此，只要仪器设备出现故障，都只能再花钱找厂家解决。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 然而，找厂家解决价格不菲。骆汉生说，目前，各医院的大型设备如ct机、核磁共振仪(mri)等，基本只能依赖购买保修合同来保证设备运行，年保修价格更从十几年前占合同费用的6%飙涨到了目前的近15%。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 而每当中国方面质疑其保修价格时，外资企业会解释技术说明书有许多属于专利的秘密信息，必须进行保护。“但同样是设备维修领域，波音飞机等却并非由厂家维修。”骆汉生质疑。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> “这不是专利问题，是不履行技术说明书的提供义务的问题。”他说，进口医疗设备基本上都有维修软件，而使用这些软件所需要的技术说明书是货物的组成部分。</p><p style="font-family: Simsun; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 据透露，外企的另一个垄断行为是为维修软件设置密码。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 在不需要密码的时代，骆汉生不到两个小时就可以维修一台ct机。设置密码后，维修成本增加了，效率反而降低了，而且“维修时间延长了，实际上是种安全隐患”。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 作为这一市场多年的观察者，《中国医疗设备》杂志社社长金东亦深有同感。他对记者说，外资医疗企业在中国香港并不是这么做。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 金东说，外资企业在内地的利润主要来自售后维修，它们不向购买者提供维修相关文件以垄断售后市场，并借机赚得高额利润。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 在8日的会场上，金东给出了一串数据：外资品牌在中国医疗器械市场的利润主要分为销售利润和售后维修利润，两者所占比例分别为25%和75%。售后市场才是外资企业在中国经营医疗器械利润的主要来源，而这一售后市场正处于被外资企业垄断状态中，导致维修价格昂贵。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; margin-top: 10px;"> 面对中国技师的“指控”，一家知名外资医疗器械公司的相关负责人对记者说，外资医疗器械公司在中国并不存在“垄断”的说法。“我们一直都按中国的法律法规办事。”</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 然而，按照中国的法律，进口医疗器械的产品说明书是不应该消失的。今年6月1日起实施的新版《医疗器械监督管理条例》第四十二条有明确规定：“进口的医疗器械应当有中文说明书、中文标签。说明书、标签应当符合本条例规定以及相关强制性标准的要求。”</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 国家食药监总局也出台过更详细的规定。根据《医疗器械说明书、标签和包装标识管理规定》，医疗器械说明书一般应当包括“产品的性能、主要结构、适用范围”、“安装和使用说明或者图示”、“产品维护和保养方法，特殊储存条件、方法”。其中对于医疗器械说明书中有关安装使用的内容，包括“产品安装说明及技术图、线路图”、“产品正确安装所必需的环境条件及鉴别是否正确安装的技术信息”以及“其他特殊安装要求”。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 骆汉生认为，根据现有的法律法规，随机文件是否缺少关键的技术维修信息，还需要相关部门加强监督检查。</p><p style="font-family: Simsun; font-size: 14px; line-height: 24px; white-space: normal; background-color: rgb(249, 249, 249); margin-top: 10px;"> 今年以来，种种迹象表明，政府正希望在医疗器械特别是高端医疗设备领域推进“国产化”进程。今年5月，国家主席习近平在上海考察调研期间，专门视察了上海的一家医疗设备公司，并表示：“现在一些高端医疗设备基层买不起、老百姓用不起，要加快高端医疗设备国产化进程，降低成本，推动民族品牌企业不断发展。”几天后，卫计委官方网站发布通知，表示会组织优秀国产医疗设备产品的遴选工作。</p><p style="font-family: Simsun;
