<p><span style="font-size: 14px;"> 大型医疗设备采购黑幕重重。</span></p><p><br /></p><p><span style="font-size: 14px;"> 1月25日，原安徽省界首市卫生局副局长、界首市人民医院院长李国庆因受贿案的终审判决公开，而GE（通用电气）业务员“不光彩”地出现在行贿人名单中。</span></p><p><br /></p><p><span style="font-size: 14px;"> 房某并不是只卷入了李国庆这一起腐败案。其和三大外资医疗设备制造商中西门子业务员安某都卷入了原阜阳市人民医院院长高学中腐败案的旋涡中。值得关注的是，安某亦是阜阳多起医疗系统腐败案的行贿人。</span></p><p><br /></p><p><span style="font-size: 14px;"> 《中国经营报》记者在调查中发现，在医疗系统大型医疗设备采购中存在诸多“潜规则”，而出行贿受贿手段也呈现出更加隐蔽的趋势，对医疗系统腐败案件的查处还需要在处罚医生和医院管理层的同时，提高药商、药械商的监管和处罚力度。</span></p><p><br /></p><p><span style="font-size: 14px;"> 而对于接连有工作人员涉入腐败案，GE、西门子均回应称，目前公司正在进行内部核查，将对具体问题尽快做出回应。</span></p><p><br /></p><p><span style="font-size: 14px;"> <strong>GE涉入多起腐败案</strong></span></p><p><br /></p><p><span style="font-size: 14px;"> 司法文件显示，2002年，界首市人民医院准备购置一台核磁共振，当时参加竞标的除了美国GE公司，还有西门子公司、飞利浦公司等。经过议标，在李国庆院长的帮助下，美国GE最后中标。</span></p><p><br /></p><p><span style="font-size: 14px;"> 大概在2002年11月底，美国GE公司业务员房某代表公司和界首市人民医院签订了价值为430万元的核磁共振成像系统销售合同。在机器安装调试完毕后，房某为了感谢李国庆的帮助以及要剩余的货款，就从家里拿了3万元现金装在一个牛皮纸信封里面交给李国庆，李国庆当时没作太多推辞就收下了。</span></p><p><br /></p><p><span style="font-size: 14px;"> 2007年上半年，美国GE公司准备向界首市人民医院销售一台加速器，房某特别想把这笔生意做成。一天其去了李国庆的办公室里，去之前其随身带了装在一个牛皮纸信封里面的1万元现金，就把这个信封塞给了他，李国庆客气几句便收下了。后来，在李国庆的帮助下，其公司顺利的向界首市人民医院销售了这台加速器。</span></p><p><br /></p><p><span style="font-size: 14px;"> 事实上，房某并不是只卷入了李国庆这一起腐败案。</span></p><p><br /></p><p><span style="font-size: 14px;"> 据原阜阳市人民医院院长高学中供述，2004年阜阳市人民医院申请了200多万美元的外国贷款，按要求该款必须购买在以色列生产的设备。在办理贷款过程中，美国GE公司安徽办事处负责人房某多次找到他，希望医院使用美国GE公司的设备，GE公司在以色列有生产车间，并表示事成之后会感谢，其答应帮忙。在招标过程中，其安排相关人员向招标公司提供购买B超机、CT机等设备的标准时倾向于使用美国GE公司的产品，该公司顺利中标。</span></p><p><br /></p><p><span style="font-size: 14px;"> 2009年在合肥开会期间，房某请高学中吃饭，并想表示感谢，其怕直接收钱有影响，就安排房某找其妻弟马某甲。后来马某甲告诉其房某送了1万欧元，其到北京出差时将1万欧元兑换了8.6万元人民币。GE中国方面对此没有做出回应。</span></p><p><br /></p><p><span style="font-size: 14px;"> <strong>大型医疗设备采购暗藏潜规则</strong></span></p><p><br /></p><p><span style="font-size: 14px;"> 据《中国医疗设备》杂志社发布的《2014中国医疗设备售后服务调查报告》，被业界称为GPS的通用（GE）、飞利浦（Philips）、西门子（Siemens）三家跨国企业，在CT、核磁共振、核医学、血管造影机等几类大型医疗设备中长期占据龙头地位，市场份额已超过80%。</span></p><p><br /></p><p><span style="font-size: 14px;"> 事实上，西门子也卷入了高学中腐败案旋涡中。</span></p><p><br /></p><p><span style="font-size: 14px;"> 不过，在西门子中标阜阳市人民医院核磁共振设备的过程中，时任西门子中国有限公司皖北地区销售经理安某的暗箱操作显得更加隐蔽。</span></p><p><br /></p><p><span style="font-size: 14px;"> 2010年上半年，安某听说阜阳市人民医院准备购买一台核磁共振，其想让阜阳市人民医院购买西门子公司的产品，多次找到负责采购的该院设备科负责人付志成，并让付志成在制作投标文件中多体现西门子公司产品技术优势，许诺如果西门子公司中标，给他20万元好处。</span></p><p><br /></p><p><span style="font-size: 14px;"> 安某从付志成处得知原北京安亿仕科贸有限公司经理王伟和市医院的领导关系密切，就联系王伟说想跟他合作核磁共振的事，向其承诺如果王伟使西门子公司的产品顺利中标，即将核磁共振的三方采购合同交给安亿仕公司做。由他负责对医院领导进行公关，其给他一个设备底价，将来设备合同价格超出底价的部分都给王伟，其中包括给医院领导的公关费用，公关费用如何使用其不过问，只要能做成就行。</span></p><p><br /></p><p><span style="font-size: 14px;"> 王伟为使西门子公司的产品顺利中标，同时使安亿仕公司能拿到采购合同，请求时任阜阳市人民医院院长高学中支持西门子公司的产品，并允诺中标后给予高学中好处，高学中表示同意。后在高学中的帮助下，西门子公司的核磁共振设备顺利中标，合同价为1100多万元。为表示感谢，被告人王伟通过马某甲分二次送给高学中现金共计90万元。</span></p><p><br /></p><p><span style="font-size: 14px;"> 2011年上半年，安某为兑现承诺，安排合作商王伟向付志成提供的银行卡内存入人民币20万元。</span></p><p><br /></p><p><span style="font-size: 14px;"> 2013年下半年，安某自己为兑现付志成在其公司中标阜阳市人民医院采购一台CT机的承诺，向付志成提供的陈某银行卡内存入人民币10万元，通过济南中强医疗设备工程有限公司与安徽亚美亚进出口贸易有限公司签订虚假合同的方式给予付志成人民币10万元，计20万元。</span></p><p><br /></p><p><span style="font-size: 14px;"> 司法文件显示，安某亦曾向阜阳市肿瘤医院院长刘华顶、该院医疗设备科科长行贿。</span></p><p><br /></p><p><span style="font-size: 14px;"> 安某证言显示，2008年1月，他负责西门子中国有限公司皖北地区医疗影像产品销售。2009年阜阳市肿瘤医院购买直线加速器时，他认识了刘华顶。当时刘华顶系肿瘤医院副院长，2010年4月任院长。2010年10月，他通过招标销售给肿瘤医院一台核磁共振仪，中标价格约1100万元，招标前他找到刘华顶许诺如招标成功，给刘华顶60万元好处费。招标成功后，他找到刘华顶提出要把60万元给刘华顶，刘华顶称现在医院不太平，有人写检举信告其，让钱先放在他处。2011、2012年他多次提出把60万元给刘华顶，刘华顶怕问题暴露，均称先放在他处以后再说，该60万元一直在他处保管。</span></p><p><br /></p><p><span style="font-size: 14px;"> 不仅如此，阜南县人民检察院在办理刘华顶涉嫌受贿一案中，发现了阜阳市肿瘤医院设备科科长冯某某涉嫌受贿的线索。</span></p><p><br /></p><p><span style="font-size: 14px;"> 冯某某受贿案二审刑事判决书显示，2010年，被告人冯某某利用担任阜阳市肿瘤医院医疗设备科科长的职务便利，接受西门子（中国）有限公司销售经理安某的请托，为该公司出售给阜阳市肿瘤医院磁共振系统提供帮助。2011年4月左右，被告人冯某某在阜阳市红旗中学附近收受安某某一部尼康牌D90单反相机。经鉴定，该相机价值6900元。</span></p><p><br /></p><p><span style="font-size: 14px;"> 西门子医疗对此表示，该司已知晓记者采访的相关事件。公司业已开展对相关问题的内部调查，目前调查正在进行中。</span></p><p><br /></p><p><span style="font-size: 14px;"> 西门子公司高度重视在市场运营中秉持诚信和公平竞争的原则。我们的根本原则是：只有廉洁的业务才是西门子的业务。对公司员工涉嫌违反相关法律法规的行为，西门子将积极配合有关部门的调查工作。</span></p><p><br /></p><p><span style="font-size: 14px;"> 司法文件显示，2011年至2013年间，被告人葛艺东利用担任芜湖市第二医疗集团党委委员、副院长的职务便利，收受西门子（中国）有限公司区域经理房某铂金项链一条（价值6462元）、接受房某为其报销发票费用累计1.5万元，为房某在芜湖市第二人民医院销售设备器械提供帮助和关照。</span></p><p><br /></p><p><span style="font-size: 14px;"> <strong>商业贿赂“黑名单”亟待建立</strong></span></p><p><br /></p><p><span style="font-size: 14px;"> 据了解，目前安徽多地医院系统受贿人员高学中、付志成、刘华顶、冯某某、王伟等皆被追究刑责。</span></p><p><br /></p><p><span style="font-size: 14px;"> 不过，本报记者注意到，GE、西门子涉案的业务员都是以证人的身份出现在判决书中，而没有注明被另案处理。</span></p><p><br /></p><p><span style="font-size: 14px;"> 某高校医疗产业研究人士在接受《中国经营报》记者采访时表示，GE、西门子相继卷入安徽多起医疗腐败案，揭示出大型医疗设备采购中一直存在着潜规则。与药品采购不一样，经手大型设备采购都是医院管理层少数几个人，行贿受贿显得更加隐蔽。</span></p><p><br /></p><p><span style="font-size: 14px;"> 值得追问的是，受贿者锒铛入狱，行贿者或因情节轻微不能被刑事追责。那么，从中获益的企业就可以“全身而退”吗？</span></p><p><br /></p><p><span style="font-size: 14px;"> 事实上，国家相关部门早就建立了医药购销领域商业贿赂“黑名单”制度，药品和医疗器械企业一旦实施商业贿赂被发现将被列入不良记录，影响其产品招标采购。</span></p><p><br /></p><p><span style="font-size: 14px;"> 根据上述规定，上述涉事企业理当列入安徽省医药购销领域商业贿赂不良记录。然而，迄今为止安徽省公布的列入“黑名单”的企业寥寥无几，上述企业无一牵涉。</span></p><p><br /></p><p><span style="font-size: 14px;"> 有关人士认为：“医疗反腐败，我们注重了对医生和医院管理层行为的监管，然而却忽视了对药商、药械商的监管。作为企业当然追求销售最大化、利润最大化，在缺乏监管的情况下，必然会出现一些行为失范。”</span></p><p><span style="font-size: 14px;"><br /></span></p><hr /><p><img data-s="300,640"
