【仁成医疗】医疗器械行业亟需走出"专利丛林"

“国内中高端医疗器械主要依靠进口，约80%的CT 市场、90%的超声波仪器市场、85%的检验仪器市场、90%的磁共振设备、90%的市场、80%的中高档监视仪市场、90%的高档生理记录仪市场以及60%的睡眠图仪市场均被外国品牌所占据。”2013年11月中国医药物资协会发布的《2013中国医疗器械行业发展状况》蓝皮书中披露的现状令人触目惊心。有业内人士表示，高端医疗设备依赖进口，直接导致了高端、大型医疗设备在中国的销售价格和维护价格居高不下，这也是中国人“看病贵、看病难”的重要原因之一。 　　在医疗器械行业，我国企业是“跟随者”，不得不在国外跨国公司严密的专利布局中夹缝求生。而且，近年来我国医疗器械企业已经多次遭受国外竞争对手“专利利器”的打压。中国医疗器械企业如何在“专利丛林”中走出自己的道路，在技术赶超的过程中保护自己?日前在深圳举行的生命科学知识产权研讨会上，作为资深的知识产权专家，赛恩倍吉集团首席执行官周延鹏就上述问题阐述了自己的看法。 　　行业进入“专利丛林” 　　“在医疗器械行业，目前中国大陆地区的高端产品都主要依赖进口。与之相似，中国台湾地区目前大约二成医疗器械自产，八成依靠进口。药品市场也是差不多的情况。”周延鹏谈到。 　　周延鹏认为，要打破国外跨国公司在高端医疗器械行业的市场和技术垄断，最重要的是加大研发力度，进行科技创新，从技术上赶超对手。但是，只做到这一点是远远不够的。一定要在赶超的过程中解决知识产权问题。这一问题得不到解决，医疗器械企业在国内随时都有可能受到国外竞争对手“专利武器”的打压，更不用说走出去。 　　“对医疗器械行业知识产权状况的了解，可以对照ICT（信息、通信和技术）产业所面临的知识产权问题。”周延鹏谈到，以小米公司为例，手机产品刚进入印度市场就被“专利利器”打了回来，而这种情况在医疗器械行业甚至要更为严重。“在医疗器械行业，国外跨国公司在中国的专利布局甚至要比ICT行业更要严密，这与巨大的市场利益是分不开的。”周延鹏对记者说。 　　中国医药物资协会发布的《2014中国医疗器械行业发展》蓝皮书显示，进入21世纪以来，我国医疗器械产业整体步入高速增长阶段，销售总规模从2001年的179亿元，到2014年的约2556亿元，增长了14.28倍，成为仅次于美国的全球第二大医疗器械市场。 　　周延鹏分析，在医疗器械领域，我国企业是一个“后进者”，在这个行业早已进入了“专利丛林”。而且，医疗器械行业所面临的专利风险与ICT行业有很大不同，甚至更为凶险。首先是专利数量众多。看起来结构非常简单，就是由一个面罩和一台主机组成。但光是面罩，美国瑞思迈公司就拥有100多件美国专利，固定带背后也有1000多件专利作支撑。甚至是一颗有特殊功能的螺丝钉，都可能涉及上千件专利。这些都不是ICT行业可以比的。”其次是竞争方式不同。在ICT行业，国外跨国企业更多的是“要钱”，通过专利许可的方式，提高国内企业的成本，而医疗器械行业是“要命“，竞争对手提起的专利诉讼以阻断产品出口通道为目的。 　　做好专利风险排查　　《2014中国医疗器械行业发展》蓝皮书指出，中国医械产业呈现多、小、高、弱的特点：生产企业多，截至2013年底，全国共有医疗器械生产企业1.5698万家;企业规模小，2013年医疗器械产业市场总产值为2120亿元，平均每个企业产值约1350万元；产品集中度高，医疗器械产品种类3500多种，平均每种产品10多个注册证。 　　正是因为中国医疗器械企业具有“多、小、高、弱”的特点，更难以承受专利诉讼的打击。“在美国瑞思迈公司诉台湾雅博公司的案件中，美国瑞思迈公司指控台湾雅博公司侵犯其7件专利。这起案件若花十几个月诉讼，台湾雅博公司将付出约500万美元到600万美元的律师费。没有几家医疗器械公司能打得起这种专利诉讼。相比较，进行专利风险排查可能花不了20万美元就可控制住风险。 　　正因为国外竞争对手在中国严密的专利布局，使得我国企业要格外重视专利风险问题。之前业界一直在谈通过专利预警或专利风险排查的方式来防范专利风险，但是一直没有找到比较好的体系、方法及系统。而单纯依赖关键字的专利检索方式难以把握整个医疗器械产业的技术发展脉络，进行专利风险排查的能力极为有限。 　　由于医疗器械行业所涉及的领域非常多，所以需要掌握的信息量非常大，在进行专利风险排查时，不能仅对专利信息进行检索，更要对非专利信息进行检索，如学术论文等。因此，认为必须用大数据来支撑医疗器械行业的专利排查与预警工作，必须要有一套能支撑这么庞大的分析检索工作量的方法与工具。 　　变革固有专利思维　　“医疗器械行业的专利竞争态势来得急又来得猛。在医疗器械行业，许多跨国公司正在学习ICT行业的知识产权运作方式，而且越来越多NPE（非专利实施主体）正在瞄准医疗器械市场，这尤其需要引起国内医疗器械企业的注意。 　　由于医疗器械产品的生命周期要远长于ICT产品，而且数量相对较少、单位价格相对较高，使得医疗器械行业对知识产权的依赖格外强。在目前医疗器械领域全球化竞争态势下，亟需打破传统的专利申请思路。 　　“过去提交专利申请的流程，通常是发明人提交交底书，然后由代理人撰写中国专利的申请文件，提交专利申请后再根据中国专利进行翻译，然后用翻译后的文件提交其他国家的专利申请。这种专利申请方式在医疗器械行业是不可行的。”行业是随时要准备打国际专利战的，过去通过翻译的方式来撰写美国等国的专利申请文件的方式，在遭遇专利诉讼时就很难有长出“牙齿”的专利进行反击。<p style="margin-top: 0px;
