Cambridge Ltd.（以下简称“Illumina”）在香港特别行政区高等法院起诉深圳华大智造科技股份有限公司、MGI International Sales co., Limited、香港华大基因医疗设备有限公司、华大基因香港研发中心有限公司、香港华大基因科技服务有限公司、华大基因健康科技（香港）有限公司，侵犯了其在香港的专利，并同时向香港法院申请了临时禁制令。</strong></span></section><section><span><strong><br  /></strong></span></section><section><br  /></section><section><strong><span>相关诉请及进展</span></strong><span></span></section><section><strong><span><br  /></span></strong></section><section><br  /></section><section><span>据悉，此次被告一至四为深圳华大智造科技股份有限公司、MGI International Sales co., Limited、香港华大基因医疗设备有限公司、华大基因香港研发中心有限公司，系华大基因关联方。被告五至六为香港华大基因科技服务有限公司、华大基因健康科技（香港）有限公司，系深圳华大基因股份有限公司控股子公司。</span></section><section><span><br  /></span></section><section><br  /></section><section><strong><span>Illumina诉称，被告侵犯了Illumina在香港的标准专利（专利号为HK1253509，该专利申请发表时间为2019年6月21日，被授予专利的发表日期为2020年8月7日），涉嫌被诉侵权的产品及服务主要包括MGISEQ-2000RS、MGISEQ-2000RS FAST、MGISEQ-2000CX、DNBSEQ-G400RS、DNBSEQ-G400RS FAST 、DNBSEQ-G400CX 、DNBSEQ-G50、DNBSEQ-G50RS、DNBSEQ-G50CX、 MGISEQ-200、MGISEQ-200RS、MGISEQ-200CX、DNBSEQ-T7、DNBSEQ-T7RS、DNBSEQ Tx、DNBSEQ E series、BGISEQ-500RS、BGISEQ-50及其配套试剂以及相关服务。</span></strong><span></span></section><section><strong><span><br  /></span></strong></section><section><br  /></section><section><span>Illumina要求香港法院宣布被告侵犯了原告在香港的标准专利（专利号 HK1253509）,并要求被告就其侵权行为向Illumina作出经济赔偿及交出就其侵权行为而获得的所有利润。</span></section><section><span><br  /></span></section><section><br  /></section><section><span>illumina同时向香港法院申请了临时禁制令，请求禁止被告、任何一个由被告或通过第三方直接或间接控制的主管人员、高级职员、员工、代理人、代表人、母公司、子公司分支机构或任何实体制造、销售、使用、进口、储存、供应涉及侵权的测序仪及配套试剂（盒）；禁止使用、提供使用、投放市场、供应涉及侵权的测序仪产品(不论被告目标市场是在香港或其他地方)；禁止任何促进使用侵权测序仪及配套试剂的侵权服务；禁止授权、诱导、指挥他人或者与他人共同实施上述侵权行为。</span></section><section><span><br  /></span></section><section><br  /></section><section><strong><span>截至目前，该案件暂仅处于已被受理尚待审理环节，illumina申请的临时禁制令亦尚未审理；被告是否构成侵权及原告的临时禁制令申请或原告相关诉讼请求是否相应被法院支持均尚待香港法院的审理决定。</span></strong><span></span></section><section><strong><span><br  /></span></strong></section><section><br  /></section><section><span>根据《公告》透露，华大基因被涉诉关联企业正积极应对竞争对手的诉讼，在香港法院发布临时禁制令或最终做出判决之前，涉诉关联公司涉诉产品及服务相关业务不受影响。假若香港法院颁下临时禁制令，鉴于专利具有地域性，而目前该案件针对的侵权专利为原告在香港的专利，该案件主要影响的系涉诉控股子公司在香港的与涉诉产品及服务相关的业务，对华大基因其他业务经营暂时不存在直接不利影响。</span></section><section><span><br  /></span></section><section><br  /></section><section><span>根据《公告》，针对可能发生的相关诉讼风险，涉诉控股子公司也已提前做了相关准备，多平台策略正在同步有序推进，继续为客户提供优质的产品和服务。此外，涉诉控股子公司在香港进行的新冠检测所使用的方法和产品主要基于 荧光定量PCR技术，与涉诉产品及服务关联度较小，该诉讼对于新冠检测服务与新冠检测试剂盒的销售不构成重大不利影响。</span></section><section><span><br  /></span></section><section><br  /></section><section><span>由于案件尚未开庭，且illumina并未明确具体起诉金额，故暂时无法判断对华大基因后续的财务影响。我们将持续关注后续进展。</span></section><section><section><br  /></section></section><p><br  /></p><section><section
