美国N95口罩申请审批优先级变更，中国企业：我还有机会吗？

/></p><p><span>日前，美国疾病控制与预防中心(CDC)下属的国家职业安全卫生研究所(NIOSH)在其官网更新了致所有生产商的公告内容，更新了N95产品申请人的审批优先顺序，降低了非美国境内申请人的优先等级。</span></p><p><br  /></p><p><p><img /></section><p><span>相比于4月中旬，此次调整主要集中在以下几个方面：<br  /></span></p><p><br  /></p><section data-tools="新媒体排版" data-id="13440" data-style-type="9"><section mpa-from-tpl="t"><section mpa-from-tpl="t"><section mpa-from-tpl="t"><p><strong><span>1. 明确指出不接受包括耳挂式在内的新型耳带样式的口罩申请，将集中精力审批传统的两条头带式的口罩产品；</span></strong></p><p><br  /></p><p><strong><span>2. 更新了外科用N95口罩的相关指南(简称”SN95指南”)，提出该类产品申请的制造商必须遵循此指南的内容；</span></strong></p><p><br  /></p><p><strong><span>3. 对不同类型申请人，将按以下优先顺序进行依次审批：</span></strong></p><p><br  /></p><p><strong><span>1) 已批准的美国境内申请人，申请新的或扩充的产品(包括遵循”SN95指南”提出的上述申请)；</span></strong></p><p><strong><span>2) 已批准的美国境内及境外申请人，申请新增厂址；</span></strong></p><p><strong><span>3) 新的美国境内申请人；</span></strong></p><p><strong><span>4) 已批准的境外申请人，遵循”SN95指南”提出的新产品申请；</span></strong></p><p><strong><span>5) 已批准的境外申请人，提出的新产品申请；</span></strong></p><p><strong><span>6) 新的境外申请人，遵循”SN95指南”提出的新产品申请，优先考虑在加拿大和墨西哥生产的产品；</span></strong></p><p><strong><span>7) 新的境外申请人，提出的新产品申请，优先考虑在加拿大和墨西哥生产的产品；</span></strong></p><p><strong><span>8) /></section><p><span>从此次政策调整中可以看出，美国目前对于非美国境内申请人，或非加拿大或墨西哥生产的产品，<strong>申请NIOSH认证完全不在优先审批的列表之中</strong>，完成时间无法估计，可以说从源头上阻断了非美国、加拿大和墨西哥以外的N95口罩进入美国。</span></p><p><span><br  /></span></p><p><span>到这里我们不禁会开始担忧，中国向美国出口了大量口罩等抗议物资，那会不会受到政策变化的影响？毕竟自美国疫情爆发至今，中国口罩商与美国的合作虽然不少，但一直磕磕绊绊状况不断。<br  /></span></p><p><span><br  /></span></p><p><span>早在2020年3月17日，美国疾病预防与控制中心（简称CDC）官网明确公众在物资不足的情况下，可戴其他部分国家标准的口罩，包含中国KN/KP95或KN/KP100口罩。</span></p><p><span><br  /></span></p><p><span>然而3月28日，为缓解全国医疗防护装备的短缺，美国FDA紧急批准了欧盟和5个国家（澳大利亚、巴西、日本、韩国、墨西哥）认证的非N95口罩，但中国标准KN95口罩没有获得紧急授权。也就是说，名列CDC指南之内KN95口罩被美国FDA从合格釆购名单中拿掉。</span></p><p><span><br  />美国新闻网站BuzzFeed 3月29日的报道称，KN95口罩是N95口罩的中国替代品，但美国FDA拒绝允许其进入美国，这一决定背后有“政治原因”。后来美国疫情快速扩散，4月3日，美国FDA官员称不会阻止进口中国标准口罩，当日官网公布EUA新文件予以说明。</span></p><p><span><br  /></span></p><p><span>今年4月时我国比亚迪公司与美国加州的口罩生意就因为FDA的审批问题差点分道扬镳，当时该事件在国内还产生了巨大关注，不过好在事后经调查该事件不是针对比亚迪的特例，当时与比亚迪有着相同遭遇的还有美国两家本土口罩公司，他们的待遇更惨直接取消订单，而最后加州对比亚迪的认证日期延后一个月，今年7月美国加州决定加大进口口罩，州长纽瑟姆表示将从中国比亚迪公司追加购买4.2亿只口罩。</span></p><p><span><br  /></span></p><p><span>从种种迹象表明，NIOSH新政策标志着美国将再次尝试拜托对境外抗议物资的依赖，疫情初期美国近90%的口罩产能来源于中国，在美国本土产能相继增长后，就在不断地做这种尝试，这已不足为奇。而新政策之下，我国N95级口罩生产商想要进入美国市场需做好长时间审核的心理准备，不过对于已经过审的中国企业理论上不会有影响。</span></p><p><br data-style-id="22631"><section><section><p><strong>03</strong></p></section><section><p><span><strong><strong>关于NIOSH</strong></strong></span></p></section></section></section><section><br  /></section></section></section></section></section><p><span>NIOSH隶属于美国疾控中心CDC，负责个人防护呼吸器N95的认证，FDA是负责医用口罩的注册审核，医用N95口罩则是经过两家机构的认证注册。</span></p><p><br  /></p><p><p><img src="image/20201014/6034536decf57caa4b00958946bca451_3.jpg" /></p></p><p><br  /></p><p><span>对于首次申请N95的生产商，申请分为两阶段：</span></p><p><span><br  /></span></p><p><span>1.提交一份调查表和照片（企业工厂外观、产品生产线等）给NPPTL评估，NPPTL评估合格后，会给生产商一个企业代码（Three-character Manufacturer’s Code ）和其它相关资料。</span></p><p><br  /></p><p><span>2.收到NPPTL寄来的文件后，准备详细的申请资料，除了填写标准的表格外，企业还需提供符合标准要求资料。通过认证后，NIOSH会给申请者一个测试和认证批准号(TC ，Testing and Certification Number)和批准标识。<strong>NIOSH认证平均时长为94.8天</strong>，<strong>最短22天，最长189天</strong>。生产商获得N95认证后，NIOSH每年会对生厂商在市场上销售的认证产品进行抽查，以确定企业是否始终符合N95的要求。</span></p><p><span><br  /></span></p><p><p><img
