white-space: normal; background-color: rgb(255, 255, 255);">　　在欧盟，立法进程是首先由欧盟委员会（European Commission， EC）提出新的法案，然后由欧洲议会对此提案及其立法文本进行投票，并修订立法文本，一旦投票通过，那么欧盟理事会将负责证实通过提案的普遍方法，最后由欧盟理事会、欧盟委员会和欧洲议会进行三方会谈，确定最终立法文本。 <br style="margin: 0px; padding: 0px; list-style: none; line-height: 1.5; font-size: 15px !important;"  />　　2012年，在进行了广泛的多轮公众咨询后，欧洲委员会发布了和IVD法规提案。 在接下来的两年里，欧洲议会和欧盟委员会对立法文本多次修订，终于在2014年四月通过了修订后的提案 。业界曾普遍估计，在拉脱维亚担任欧盟轮值主席国任期结束，即2014年6月30日之前，该提案的普遍方法都不会被正式通过。但出乎意料的是，2015年6月19日，在欧盟理事会EPSCO会议上正式通过了此提案。欧洲理事会主席Guntis Belēvi?s将这一举动称之为“ 增进患者安全、提升欧洲的竞争力的决定性一步。” <br style="margin: 0px; padding: 0px; list-style: none; line-height: 1.5; font-size: 15px !important;"  />　　理事会通过的普遍方法与欧盟委员会提交的方法基本一致，但更强调对公告机构、制造商上市后监督和对临床调查的严格监管。具体表现为：对公告机构的资质认定和主管当局对公告机构的监管将更严格，且公告机构将有权利执行飞行检查；制造商必须形成与其产品风险等级相匹配的上市后监督体系，且必须提交定期安全性更新报告（Periodic Safety Update Reports， PSUR） ； 对于风险高的器械，制造商需要进行临床调查来证明器械的安全和有效性，为此，新的普遍方法要求制造商必须就临床研究策略向专家团咨询并获得反馈，同时还制定了临床调查的判断标准和限制条件，并允许成员国就临床调查中的某些行为制定更严格的限制。 <br style="margin: 0px; padding: 0px; list-style: none; line-height: 1.5; font-size: 15px !important;"  />　　该提案的普遍方法一出台，MedTech集团就发表声明，欢迎欧盟理事会这一进展，但同时也对该提案的某些方面表示不赞同。 首先，MedTech认为新提案提出的由主管当局进行额外审查会对企业产生负担。其次，MedTech也对新提案中允许加工处理商或医院回收利用一次性使用器械的条款表示反对，认为这样可能危害患者健康，并且可能会影响新的一次性使用器械的销售。在IVD领域，新提案允许法案正式生效之前存在五年过渡期，MedTech对此表示感谢，但同时也认为新提案对IVD的临床证据的要求过于繁冗，且“不确定对患者有何益处”，并且认为”伴随诊断”（companion diagnostics）的概念过于宽泛，会将很多简单的诊断方法归入伴随诊断的范围。</p><p style=""><span style="margin: 0px;
