color: rgb(85, 85, 85); font-family: Arial, 宋体, Helvetica, sans-serif; white-space: normal; background-color: rgb(255, 255, 255);"> 在美国，医疗器械法规是药品法的一个附属部分，对器械的要求自然也采用了与药品法规相同的模式，其管理更是建立在具体的产品数据库之上。而中国和欧洲则是为医疗器械单独立法，根据器械特点采纳了工程管理模式，并以原则为导向配合标准的应用。总体来说，美国法规的要求要更严于欧洲和中国；但是由于药械之间的显着差异，将源于药品法的一些要求用在器械管理中，在很多情况下被认为是不合适的。 2.定义和界定 与欧盟MDD中的定义相比，美国FDCA中提供了一个相对狭隘的定义，但却在FDA指导文件中给出了非常宽泛的阐释，并加上充分的数据库资源，从而弥补了定义中的不足。中国法规中的定义和欧洲MDD的完全一致，但却有着不同的阐释，如残疾人使用的轮椅和义肢、眼镜，其使用目的和方式符合法规中的定义，却在指导文件中被认定为非医疗器械。同时，中国的法规对药械复合产品与组织工程产品没有明确的指导方向。 3.分类规则<p style="margin-top: 0px; margin-bottom: 0px; padding: 0px; list-style: none; border: 0px; line-height: 30px; font-size: 15px; color: rgb(85, 85, 85); font-family: Arial, 宋体, Helvetica, sans-serif; white-space: normal; background-color: rgb(255, 255, 255);"> 美国最早提出对医疗器械进行分类管理以提高管理效率，欧盟和中国随后继承了这个管理模式，但各国在具体的分类规则上有明显差异。首先，欧洲MDD将所有产品分为4个管理类别；而美国和中国则将产品分为3个管理类别。 由于医疗器械涉及的产品众多，欧洲的4个等级的分类制度被认为更合理，因此被GHTF采纳进指导文件中。其次，欧盟的分类制度以分类原则作为依据；美国则是以医疗器械分类数据库为依据，并由专家小组作为技术支持；中国针对市场机制尚不成熟的情况，目前按照“分类原则加分类目录”并“以分类目录优先”的原则，实施管理。还有，三大体系在高风险医疗器械所占比例上也有较大差异。美国和欧洲只有8%～10%的医疗器械被划分为高风险产品管理；而中国的这个比例则超过了20%。事实上，过多的产品被划分为Ⅲ类高风险产品管理，既给生产者带来沉重的经济负担，又造成政府管理上的高成本和低效率。 4.产品责任主体<p style="margin-top: 0px; margin-bottom: 0px; padding: 0px; list-style: none; border: 0px; line-height: 30px; font-size: 15px; color: rgb(85, 85, 85); font-family: Arial, 宋体, Helvetica, sans-serif; white-space: normal; background-color: rgb(255, 255, 255);"> 美国对医疗器械的质量体系要求是单独立法，作为强制执行的要求。欧盟并没有独立的质量体系法规，而是将要求融入欧洲统一标准中，并在产品上市前审查环节加以体现。此外，在欧盟MDD已成功地将对质量体系的保证作为产品上市前控制的主要手段。而中国仍沿用最终产品审查作为产品控制的主要方式，并且割裂了产品控制和质量体系管理。 6.上市前控制 上市前控制模式的差异主要体现在对标准的应用、技术和专家的支持、对有效性的要求和产品审查的灵活性等方面。欧盟和美国将标准作为上市前控制的技术指标，由于充分意识到标准体系的重要性，政府十分关注标准体系的建设，并与国际化标准组织保持密切合作，以获得最新的标准知识和信息。欧盟在医疗器械指令中确立了标准的法定地位，将标准的要求作为关键的安全审查依据。中国建立了自己的标准体系，但由于人力、物力的不足，目前的标准远远不能满足产品发展的需求，国际标准的转化速度过慢成为最主要的问题。 对于产品上市前控制这一环节，欧盟和美国都拥有充分完善的技术支持：欧盟建立了医疗器械技术委员会作为法规制订和实施技术力量；美国拥有力量更强大的专业技术小组，组成产品审查委员会；中国虽然成立了国家和省级技术审评中心和检测中心，但技术资源不足仍然是主要矛盾之一。 美国和欧盟法规对产品有效性的要求上存在差异。美国在法规中对医疗器械的有效性采用了与药品相类似的要求，必须通过合理的临床研究来验证；而欧盟则采用工程的手段来要求，更多地鼓励生产者使用文献资料和实验室资料来验证产品的有效性；中国对有效性的要求采纳了美国的经验，必须对大部分Ⅱ类和所有Ⅲ类医疗器械进行临床研究。 对同一产品的上市前审查，欧盟MDD提供了不同的申报途径，生产者可以根据自己的实际情况进行选择。欧盟对上市前审查的灵活性被认为是管理创新。而美国和中国的体系中则没有这样的灵活机制。同时，美国和欧盟简化了部分Ⅰ类产品的管理，无须管理部门介入，由企业自行管理。 7.上市后控制 美国和欧盟都对上市后的医疗器械有严格要求，FDA的上市后监督主要通过GMP、医疗器械报告制度、医疗器械跟踪制度和医疗器械召回制度来实现；欧洲基本采纳了美国的经验，建立了类似的报告制度和上市后监管体系；目前，中国对上市后的管理制度正在建设之中，两年前开始法规的调研和起草工作，不良事件报告制度正在试行，但立法者和管理者对不良事件管理的方法学及上市后监管有效性的评价仍不甚理解。 8.执行模式<p style="margin-top: 0px; margin-bottom: 0px; padding: 0px; list-style: none; border: 0px; line-height: 30px; font-size: 15px; color: rgb(85, 85, 85); font-family: Arial, 宋体, Helvetica, sans-serif; white-space: normal; background-color: rgb(255, 255, 255);"> 在法规的执行模式上，美国采用集中式管理，欧盟采用分权式管理，而中国则介于二者之间。FDA的器械与放射卫生中心是美国医疗器械法规的执行部门，是一个中央集权的机构；欧盟则采用分权的方式，由各成员国将医疗器械指令转化为各自的法规，并将上市前的管理通过签约的形式委托给第三方机构；中国的执行机构设有三个层级并根据产品风险采用分级制模式，中央政府负责高风险产品，而地方政府负责风险相对较低的产品。其中，欧洲的分级式管理是近年来西方行政管理改革的新理念，被认为是一个更灵活有效的政府管理模式。<span style="margin: 0px;
