专项整治！捐赠器械、大中型设备、高值耗材重点查

医药网4月5日讯　前不久，《中国消费者报》的一则新闻引发关注：遍及全国30省份1000家基层医疗机构的同一款“进口”全自动生化分析仪，都是未依法注册的拼装假货。 　　实际上，该起案件早在2016年初就被公布出来，湖北省药监局将其列入2015年全省食药违法典型案例，这也是湖北省药监局成立以来查办的最大医疗器械造假案。 　　只不过，当时未曾披露出来的是，假货流入基层医疗机构是通过正规慈善组织的慈善医疗济困行动。 　　医疗器械捐赠，除了规避招标、耗材捆绑、回扣盛行这些问题之外，竟还能成为未依法注册医疗器械流入医疗机构的漏洞所在。而当慈善捐赠都能成为非法牟利的手段，我们又还能信谁？ 　　福建专项整治未依法注册器械，捐赠、转让重点查 　　据福建省药监局消息，该局已在清明节前夕部署开展使用未依法注册医疗器械的专项整治工作。 　　依据福建省药监局下发的专项整治方案，重点检查对象为：全省县级医疗机构、乡镇卫生院、社区卫生服务中心、民营医疗器械使用单位、被承包（或合作）的公立医疗器械使用单位等，及有被投诉举报等问题线索的医疗器械使用单位进行检查。 　　检查时间截止今年8月31日。而四类医疗器械重点检查，包括： 　　一是中、大型医疗设备。 　　如：B型超声诊断仪、彩色超声诊断系统、医用X射线设备等医学影像设备（含医用X射线管、管组件或源组件），自动生化分析仪、免疫分析系统等临床检验分析仪器，多参数监护仪等医用电子仪器，诊断用纤维内窥镜等医用光学内窥镜设备，激光手术和治疗设备等医用激光仪器设备。 　　二是高值口腔科材料。 　　如：齿科植入材料、定制式义齿等口腔科材料。 　　三是植入材料和介入器材等高值医疗器械。 　　如：乳房假体、支架等植入材料和人工器官，PTCA导管等血管内导管。 　　四是转让、捐赠医疗器械。 　　检查医疗器械使用单位之间转让的在用医疗器械、医疗器械使用单位接受医疗器械生产经营企业或者其他非政府组织、慈善机构及个人捐赠的医疗器械。 　　使用捐赠的未依法注册器械，福建4家医疗机构被重罚 　　福建省的大检查重点指向基层医疗机构，捐赠、转让的医疗器械更是成为重点，而且不仅企业捐赠的要查，NGO和慈善机构捐赠的也要查。 　　与之相关的是，据《中国消费者报》消息，福建省有4家基层医疗机构正是因为使用了未依法注册的“魅力”分析仪，而被药监部门重罚了。 　　福州市连江县黄岐镇中心卫生院，被罚款52.8万元；福州长乐市的营前街道社区卫生服务中心、航城街道社区卫生服务中心、首占卫生院，各自被罚44万。 　　药监、卫计、海关、质检…监管力度前所未有 　　厂商不得销售、医疗机构不得使用未依法注册医疗器械是最基本的要求，但是从业内现实来看，未依法注册医疗器械从未绝迹。不过，此类产品也正在面临越来越严格、或者可以说是前所未有的监管。这在刚刚过去的2016年度表现得格外突出。 　　在医疗器械生产和经营监管办法已经施行的基础之上，2016年2月1日起，药监总局颁布的《医疗器械使用质量监督管理办法》开始施行。该办法明确规定，使用单位不得购进、使用、转让未依法注册或者备案的医疗器械。使用单位接受捐赠医疗器械的，也不例外。 　　国家卫计委颁布、2016年11月1日起施行的《医疗质量管理办法》也规定，医疗机构和医师、护士使用未经批准的医疗器械，由卫计部门依法依规处理。 　　当医疗机构的使用这一最后环节也被套上“紧箍咒”之后，相应的监管和处罚也就更多、更严了，这从各地的年度食药违法违规典型案例也可以看出。甚至，河北某妇幼保健院因为使用未注册的进口超声诊断仪，被罚了近1800万元。 　　另外，海关和质检也在出手。 　　2016年4月，深圳海关联手上海等9地海关，破获某进口品牌牙科器材走私大案，多省多家医械公司被查，涉案假冒产品案值1.6亿元。这也是深圳海关首次针对口腔科器材的走私进行专项打击。 　　2016年11月，海关总署联合地方公安，统一指挥北上广等11个海关缉私局，首次大规模集中打击医疗设备（彩超诊断仪、麻醉机等）翻新走私行动，一举捣毁走私团伙19个，抓30多人，涉案案值3.8亿元。 　　以及，检验检疫部门在北上广和江苏等地，均查出涉嫌假冒、翻新的进口超声诊断仪，质检总局为此下发通报，警示全国加强检查。 　　再来看看福建省药监局要重点整治的四类未依法注册医疗器械，卷进去年大案的超声诊断仪、生化分析仪等设备、口腔科器材、捐赠的医疗器械恰好在列。 　　福建省药监局官网文章称，期望通过专项整治达到严厉打击使用未依法注册医疗器械行为，特别是严打使用走私医疗器械、使用二手翻新中、大型医疗器械行为，以及规范医疗器械的转让、捐赠行为等目标。 　　2017年度，要查未依法注册医疗器械的不仅仅是福建省。 　　2017年全国医疗器械监督管理会议上已经传出明确信号，今年药监聚焦突出问题全力以赴大整治，重点整治制假售假、虚假宣传、翻新再售等违法违规行为。各地监管部门也应加强与海关、质检等相关部门协作，以执法办案的高压态势，保障医疗器械质量安全。 　　在地方，甘肃、四川、内蒙等省份也各自提出了，今年会重点查无证医疗器械流入使用单位的行为。 <span style="color: rgb(62, 62, 62);
