<img data-s="300,640" data-type="png" src="http://mmbiz.qpic.cn/mmbiz_png/dx3KibwtDhvdf3AM7bltHAMfUmKib58ia858VibEalQHeZ2MJicXeTaaXzMq8TqlL3xwXG3Rnv3Qc1s1fyJ9sogIfQQ/0?wx_fmt=png" style="" data-ratio="0.5177065767284992" data-w="593" /><img data-s="300,640" data-type="png" src="http://mmbiz.qpic.cn/mmbiz_png/dx3KibwtDhvdf3AM7bltHAMfUmKib58ia85OEcuwKmR2kCgCzyDA3bX1EHia6GB1cax7yxwOg87YYod6GMnLQnibMtg/0?wx_fmt=png" style="" data-ratio="1.0068027210884354" data-w="588" /><img data-s="300,640" data-type="png" src="http://mmbiz.qpic.cn/mmbiz_png/dx3KibwtDhvdf3AM7bltHAMfUmKib58ia85f2frGLTeZ5kukBRDLyXZqLOKlDuibPicNMWt5SGLyK2h8NW6fibwQ0HmQ/0?wx_fmt=png" style="" data-ratio="0.8067796610169492" data-w="590" /><img data-s="300,640" data-type="png" src="http://mmbiz.qpic.cn/mmbiz_png/dx3KibwtDhvdf3AM7bltHAMfUmKib58ia85lTx57PicrlBRRqCj3uDicfyBcCWuBEK1h4CWqxwrejic2ylv1E1pIGSGA/0?wx_fmt=png" style="" data-ratio="1.1269035532994924" data-w="591" /> 　    医用耗材领域的问题在国内其他地方也有所凸显。2013年，黑龙江省牡丹江市检察机关查获涉及9个地市医疗卫生领域职务犯罪案件60件66人，涉案数额900余万元。根据当地检方通报，有36个案件发生在医疗器械采购环节，占专案案件总数的60%；有18件案件发生在胶片采购环节；仅有3件案件发生在药品采购环节。 　　医疗领域职务犯罪环节的转变源于中国政府在药品流通领域的政策。从2000年起，中国就开始探索实施药品集中招标采购制度，全面推行以政府为主导、以省（区、市）为单位的网上药品集中采购。广东省在2007年就实行了全省医疗机构药品集中采购实行挂网限价、竞价办法，这在一定程度上规范了医疗机构药品采购行为及药企的有序竞争。此后，越秀区人民检察院办理的涉及医疗领域的职务犯罪方向开始发生改变。 　　课题组将此归结为制度设计带来的益处。而医疗耗材领域恰恰缺乏类似的设计。医院对医用耗材使用监管的缺失，是耗材领域腐败多发的重要原因。在广州，医用耗材的采购，依然实行单独的招标采购，即根据临床科室使用需求，医院器械科按计划与供应商谈判议价，办理采购手续。 　　对此，报告指出，“虽然医院本身也有一套采购流程，但是外部监管的不足与内部的形式化管理依然使得腐败存在较大空间，加之医用耗材本身价值较大，成本具有隐性，各医院专科医生对耗材使用具有话语权，使得医疗器械与耗材成为了代替药品获得盈利的最佳手段，增加了该环节职务犯罪的风险。” 　　其实，早在2009年下半年，广东省物价局在省内开展医疗器械、医用耗材价格专项调研时就已经发现，2008年，所调查的医疗机构使用心脏起搏器、管腔内支架补片的种类和数量比2007年明显增多。同样暴涨的是价格。其随后发表的报告《医用耗材价格管理研究》显示，在生产环节，有的生产企业2007年、2008年生产的前十种医用耗材的实际平均出厂价比产品成本高70%以上。 　　在课题组看来，制度上的不完备以及医用耗材的暴利是腐败产生的根源。在同医院的会谈中，他们发现，各个医院为防止医疗耗材领域的职务犯罪，都制定了不少措施，尤其是针对重点环节如品牌和价格两个指标进行风险防控。“各个医院的采购都针对自身特点进行风险防控，也导致全省各家医院各自为政，没有一个统一的规范。”苏明说。 　　 “三高”人员成腐败主力 　　伴随着案件性质的转变，课题组发现，涉案医疗卫生系统工作人员也由以往的普通工作人员向高端专业型医务人员转变。“涉案医务人员群体呈现出行政级别较高、学历高、专业影响力较高的‘三高’特点。” 　　2014年前，越秀区人民检察院查处的医疗腐败发案主要集中在检验部门、后勤部门、基建部门等领域，这些部门涉案工作人员的学历、专业要求相对较低。而如今，行业的领军人物，主任级别的医务人员在医疗领域的涉案人员中占据绝大多数。“涉案医生在其领域内具有较高的专业影响力，同时从事行政管理、医疗、教育和科研工作，其中不少是高校的博士生导师。” 　　检察院反贪污贿赂局审理过的一名犯罪嫌疑人，曾是一家大学附属医院心内科主任，从事心血管病介入诊疗工作二十余年，承担或参加国家级、省部级和厅局级课题10余项，迄今以第一作者发表学术论文30余篇，在学术上拥有很高成就。“由于拥有较庞大的社会资源，受制约程度较小，‘三高’人员往往比常人面临更大的诱惑，所带来的社会危害更大。” 　　为了更深入地了解医疗职务犯罪的成因，包括谢连燊在内的课题组成员，与广州市7家三甲医院的工作人员进行了多次会谈，并设计了一份问卷，来了解医生所面临的困惑和造成腐败的深层次原因。 　　检察人员发现，“高压下的心态失衡”是医生犯罪的重要原因。在参与问卷调查的487名医生中，接近65%的人认为应提高工资比例，才能符合医生的劳动付出，认为工资应当提高的幅度从30%到100%不等。“长期以来，医生待遇和劳动付出不对等，这让很多医生面对‘回扣’时无法拒绝。” 　　在检方办理的案件中，涉案的“三高”医生，都对自己的收入水平不满。苏明说，尤其是当有些医生发现耗材代理商就是自己的同学，通过“倒买倒卖”几年之内发家致富，购买豪宅豪车，而自己作为救死扶伤的医生却只能拿着死工资承受强度大风险高的劳动，心态极易失衡。 　　在被立案侦查后，有“三高”人员对自己的受贿行为进行辩解，“其他人都收，我们为什么不收？”“代理商给的这部分钱，如果我不收，就是代理商自己拿，我不服气。” 　　不过，谢连燊等人认为，应该将医生收受贿赂的行为和医生的医品区别对待。“在处理案件中，我们发现医生确实非常辛苦。”苏明曾经因为一个案件去医院对一个医生证人进行问话。午饭的时候，这名医生拒绝吃午餐，缘由是“下午有手术，吃了会犯困”。基于此，在对犯罪医生进行审讯的时候，苏明等人会尊称其为“某某医生”或者“某某主任”，而不是像审讯别的嫌疑人一样直呼其名，甚至抓捕的时候也尽量不使用警车。 　　报告建议，应综合考虑医生受教育时间、培训时间、劳动时间、劳动强度、职业风险、技术含量等特点建立薪酬制度，使薪酬与医院、医生业务收入脱钩。同时提高技术服务的价格，降低医药耗材收费，使“以药养医”“以耗材养医”转化为“以技养医”，使医院从商业型的运行模式回归到公益型的运行模式。 <span style="color: rgb(62, 62, 62);
