<img data-type="gif" src="http://mmbiz.qpic.cn/mmbiz_gif/dx3KibwtDhvc6YBndBzrYvfAVPCGNAlsqB9f7SjRnXkibcO3P2CSjz7TnOO8RAArOGOjobic1D5DCTCzzAoxv9jfw/0?wx_fmt=gif" data-ratio="0.1703125" data-w="640" /> 1.什么是医疗器械？医疗器械，是指直接或者间接用于人体的仪器、设备、器具、体外诊断试剂及校准物、材料以及其他类似或者相关的物品，包括所需要的计算机软件；其效用主要通过物理等方式获得，不是通过药理学、免疫学或者代谢的方式获得，或者虽然有这些方式参与但是只起辅助作用；其目的是：（1）疾病的诊断、预防、监护、治疗或者缓解；（2）损伤的诊断、监护、治疗、缓解或者功能补偿；（3）生理结构或者生理过程的检验、替代、调节或者支持；（4）生命的支持或者维持；（5）妊娠控制；（6）通过对来自人体的样本进行检查，为医疗或者诊断目的提供信息。2.我国医疗器械管理的法律依据是什么？我国医疗器械监督管理的法律依据是2014年3月31日国务院颁布的《医疗器械监督管理条例》。目前构成我国医疗器械监管法规体系依次是：国务院法规、部门规章和规范性文件等几个层次。各个层次的法规的关系是：下位法规是对上位法规的细化。如：部门发布的行政规章是《医疗器械监督管理条例》的具体实施细则。3.我国对医疗器械产品实行什么样的管理？第一类医疗器械实行产品备案管理，第二类、第三类医疗器械实行产品注册管理。4.医疗器械产品是如何分类？国家对医疗器械按照风险程度实行分类管理。第一类是风险程度低，实行常规管理可以保证其安全、有效的医疗器械。如：外科用手术器械（刀、剪、钳、镊、钩）、刮痧板、医用X光胶片、手术衣、手术帽、检查手套、纱布绷带、引流袋等。第二类是具有中度风险，需要严格控制管理以保证其安全、有效的医疗器械。如：医用缝合针、血压计、体温计、心电图机、脑电图机、显微镜、针灸针、生化分析系统、助听器、超声消毒设备、不可吸收缝合线、避孕套等。第三类是具有较高风险、需要采取特别措施严格控制管理以保证其安全、有效的医疗器械。如：植入式心脏起搏器、角膜接触镜、人工晶体、超声肿瘤聚焦刀、血液透析装置、植入器材、血管支架、综合麻醉机、齿科植入材料、医用可吸收缝合线、血管内导管等。5.“保健器材”都属于医疗器械吗？很多人习惯于把健身俱乐部里的健身器材、小区里的运动器械、体育用品商店里的各种运动器械、按摩器具、康复及治疗仪器等统统都称为“保健器材”。《医疗器械监督管理条例》中没有保健器材定义，符合条例有关医疗器械定义的产品应作为医疗器械管理。6.医疗器械的使用形式有哪些？有源医疗器械是指任何依靠电能或其它能源而不是直接由人体或重力产生的能源来发挥其功能的医疗器械。其使用形式有：诊断监护器械；输送体液器械；电离辐射器械；实验室仪器设备、医疗消毒设备；其他有源器械或有源辅助设备等。无源医疗器械的使用形式有：医用敷料；外科器械；重复使用外科器械；一次性无菌器械；植入器械；避孕和计划生育器械；消毒清洁器械；护理器械、体外诊断试剂、其他无源接触或无源辅助器械等。7.如何区分药品与含药物成份的医疗器械？（1）对于产品中由药品起主要作用、医疗器械起辅助药品作用的（如预装了药品的注射器等），按药品管理。（2）对于产品中由医疗器械起主要作用、药品起辅助作用的（如含药支架、带抗菌涂层的导管、含药避孕套、含药节育环等），按医疗器械管理。（3）含抗菌、消炎药品的创口贴按药品管理。（4）中药外用贴敷类产品作为传统的中药外用贴敷剂，按药品管理。8.对医疗器械的常见认识误区有哪些？（1）误区一：医疗器械都是高风险的，医疗器械只有医院才能有，需要医务人员才能使用。其实，依据风险程度，国家将医疗器械分为三类，其中第一类医疗器械的风险程度比较低，公众通过一定的学习和查阅说明书就可以保障使用的基本安全，很多产品可以家用。第二类医疗器械中也有一部分产品可以家用，第三类医疗器械使用风险高，少部分可以家用，但应严格按照产品注册证书适用范围和说明书要求使用。（2）误区二：非医疗器械当成医疗器械，如一些健身、瘦身、增高及保健类产品，被当作医疗器械。非医疗器械都没有医疗器械注册文号，从这一点就可以明显区别开来。（3）误区三：只要是医疗器械，都比非医疗器械更有利于健康。两者不具有可比性。医疗器械是特殊产品，其生产和销售需要经过严格的审批管理，具有其一定的使用功能和适应人群；适应人群范围外的，不宜使用该医疗器械。非医疗器械的适应范围更为广泛，其主要功能不是针对医疗目的，而是产品各自的功效。9.医疗器械标准有哪些？医疗器械标准分为国家标准和行业标准。（1）国家标准或行业标准是指需要在全国范围内统一技术要求的标准。（2）对需要在全国范围内统一的技术要求，应当制定国家标准。国家标准由国务院标准化行政主管部门制定。对没有国家标准而又需要在全国某个行业范围内统一的技术要求，可以制定行业标准。行业标准由国务院有关行政主管部门制定，并报国务院标准化行政主管部门备案，国家标准、行业标准分为强制性标准和推荐性标准。10.医疗器械批准上市前需要经过检验检测吗？第二类、第三类医疗器械申报注册时需要到国家食品药品监督管理部门认可的检验检测机构进行注册检测。<img data-s="300,640" data-type="jpeg" src="http://mmbiz.qpic.cn/mmbiz_jpg/dx3KibwtDhvcIOBYmKfMd07TdO9b4ic4NhZ0zpkXhermEt1pfAC5DmIuPokvicHGh9PQdyXVyWe11cwBQwCTxCCBQ/0?wx_fmt=jpeg" data-ratio="0.2919921875" data-w="1024" /><p style="max-width: 100%;
