<img data-type="gif" src="http://mmbiz.qpic.cn/mmbiz_gif/dx3KibwtDhvc6YBndBzrYvfAVPCGNAlsqB9f7SjRnXkibcO3P2CSjz7TnOO8RAArOGOjobic1D5DCTCzzAoxv9jfw/0?wx_fmt=gif" class="" data-ratio="0.1703125" data-w="640" />去年5月，《中国青年报》刊文称，北京、上海、南京等地的多家知名医院、研究所将本应“仅供研究”的未经注册医疗器械，用于临床诊断。那些医疗器械均为赛默飞公司的Phadia过敏原诊断试剂产品，而北京某知名公立三甲医院也因为涉嫌使用该未经注册试剂，被北京市的药监部门立案调查。 　　2017年05月17日，上海浦东市场监管局也开出“沪食药监（浦）罚处字[2016]第2220160037号”行政处罚决定书，赛默飞世尔科技（中国）有限公司因经营无证Phadia试剂被累计罚没款近80万元。 　　这一罚单可以视为上海药监部门就赛默飞Phadia试剂争议的一个公开答复。 　　而同样是针对经营无证医疗器械这一行为，上海市药监部门在今年4月份开出的还有3个高额罚单，有3家企业分别被罚没款约43万元、21万元和54万元。 　　四大罚单密集出现，显示药监针对经营无证医疗器械违规行为的监管力度在升级。 　　以下为4起案件详情： 　　一、赛默飞世尔科技（中国）有限公司案 　　主要违法事实： 　　经查，当事人分别于2015年8月20日、2015年8月24日和2016年2月17日分三次从瑞典生产商PhadiaAB购进批号为“DN2B3”、生产日期为2014年9月的杂草类花粉混合WX5过敏原特异性IgE抗体检测试剂盒（荧光免疫法）1035盒，进价45美元/盒，当时美元兑人民币汇率为6.21，故进货价为人民币279.45元/盒。 　　嗣后，当事人于2015年9月至2016年3月期间分别以人民币576.27元/盒的价格（不含税）销售给12个经销商，以人民币658.60元/盒的价格（不含税）销售给1个经销商，共计销售525盒涉案批次医疗器械。 　　上述杂草类花粉混合WX5过敏原特异性IgE抗体检测试剂盒（荧光免疫法）的瑞典生产商PhadiaAB于2015年2月27日取得中华人民共和国医疗器械注册证（注册证编号：国械注进20153400781），涉案批次医疗器械于2014年9月生产，故该生产商在生产涉案批次医疗器械时并未取得医疗器械注册证。当事人销售涉案批次医疗器械构成经营未依法注册的医疗器械的行为。 　　至本案立案时，当事人已召回涉案批次医疗器械175盒，故实际销售数量为350盒，库存数量为675盒。本案货值金额总计590923.74元，违法所得为104133.99元。 　　上述事实，由现场笔录、询问（调查）笔录、营业执照复印件、医疗器械经营许可证复印件、涉案批次医疗器械海关进口货物报关单复印件、发票复印件、销售货物清单复印件、召回报告、医疗器械注册证复印件、召回公告网页截图打印件、召回记录表、召回产品应退款信用证明清单及收款证明等证据证实。 　　相关行政处罚： 　　依据《医疗器械监督管理条例》第六十三条第一款第（一）项，予以罚款295461.87元，没收违法所得104133.99元，没收非法财物388982.25元。 　　作出处罚的机关名称： 　　上海市浦东新区市场监督管理局 　　作出处罚的决定日期： 　　2017年05月17日 　　二、上海新华医疗开发公司案 　　主要违法事实： 　　当事人经营未经注册的第二类医疗器械压力抗栓带的行为违反了《医疗器械监督管理条例》第四十条的规定，构成经营未取得医疗器械注册证的第二类医疗器械的违法事实。 　　相关行政处罚： 　　依据《医疗器械监督管理条例》第六十三条第一款第（一）项，予以没收违法所得96266.73元，没收非法财物334564.46元。 　　作出处罚的机关名称： 　　上海市奉贤区市场监督管理局 　　作出处罚的决定日期： 　　2017年04月18日 　　三、上海舒迈医疗器械有限公司案 　　主要违法事实： 　　当事人经营未取得医疗器械注册证的压力抗栓带的行为违反了《医疗器械监督管理条例》第四十条的规定，构成经营未取得医疗器械注册证的第二类医疗器械的违法事实。 　　相关行政处罚： 　　依据《中华人民共和国行政处罚法》第二十三条、《医疗器械监督管理条例》第六十三条第一款第（一）项，予以没收违法所得125739.32元，没收非法财物80364元。 　　作出处罚的机关名称： 　　上海市奉贤区市场监督管理局 　　作出处罚的决定日期： 　　2017年04月05日 　　四、上海卫乐医疗用品科技有限公司案 　　主要违法事实： 　　当事人经营未经注册的第二类医疗器械压力抗栓带的行为违反了《医疗器械监督管理条例》第四十条的规定，构成经营未取得医疗器械注册证的第二类医疗器械的违法事实。 　　相关行政处罚： 　　依据《医疗器械监督管理条例》第六十三条第一款第（一）项，予以没收违法所得336100元，没收非法财物203080元。 　　作出处罚的机关名称： 　　上海市奉贤区市场监督管理局 　　作出处罚的决定日期： 　　2017年04月05日 <p style="max-width: 100%;
