设备捆绑耗材销售，医械企业被罚！上海工商出手了

医药网12月18日讯　前不久，上海工商针对医药圈商业贿赂现象的两大罚单引发关注。不过，其中一个罚的是药品企业，另一个罚的是医药大包商，主要面向还是药圈。而最新消息显示，上海工商也向医疗器械企业出手了！ 　　据上海市工商局网站消息，2017年12月6日，上海市浦东新区市场监督管理局作出行政处罚决定书，上海为一医疗科技有限公司涉嫌不正当竞争案，被没收违法所得 617768.74元，罚款100000元。累计罚没款超过70万元。 　　注意，这是国内又一起因“设备捆绑耗材销售”而被处罚的典型案例。而且被处罚对象，不是医院，而是向医院免费投放设备和销售耗材（试剂）的医疗器械企业。被罚依据，也是违反了《反不正当竞争法》，涉嫌商业贿赂。 　　以下为该起案件详情： 　　当事人（上海为一医疗科技有限公司）是一家医疗器械经营企业，持有《医疗器械经营许可证》。 　　2015年10月，当事人与上海市**医院签订《设备借用协议》，向上海市**医院免费出借**全自动样本处理系统、**全自动血液细胞分析仪、**全自动凝血分析仪各一套；借用期限为五年，2015年10月26日起至2020年10月25日止。借用期满，当事人有权收回上述设备或双方另行约定。 　　2015年11月至2016年2月期间，当事人分别向深圳**公司和上海**公司采购了上述设备，进货金额共计455384.61元（不含增值税）。随后，当事人将3套设备运至上海**医院安装调试。 　　上海市**医院使用上述设备，为保证检测数据的准确性，需采购**、**原厂生产的配套试剂、试纸等耗材。2016年3月1日，当事人与**医疗供应链服务公司签订《采购协议》。当事人将设备配套耗材销售给该公司，并授权该公司向医院销售。该公司应当事人的要求，将配套耗材销售给上海市**医院，开具发票，结算货款。 　　2016年3月至2017年4月案发期间，**医疗供应链服务公司向上海市**医院销售配套耗材共计1870箱（盒）。相应的，当事人销售给**医疗供应链服务公司配套耗材共计1870箱（盒），销售金额1681764.55元（不含增值税）。扣除进货成本和已缴税款，当事人获违法所得617768.74元。 　　当事人采购3套设备后计入公司财务账册固定资产科目下，并每年做折旧处理计入公司经营成本。3套设备的年折旧率20%，至五年的借用期限届满，折旧率将达到100%。2017年4月案发后，当事人停止了与上海市**医院的设备借用关系，将3套设备运回公司做培训使用。 　　上海市浦东新区市场监督管理局认为，上海为一医疗科技有限公司的上述行为，违反了《中华人民共和国反不正当竞争法》第八条第一款“经营者不得采用财物或者其他手段进行贿赂以销售或者购买商品。在帐外暗中给予对方单位或者个人回扣的，以行贿论处；对方单位或者个人在帐外暗中收受回扣的，以受贿论处”的规定，构成采用财物进行贿赂以销售商品的行为。 　　根据《中华人民共和国反不正当竞争法》第二十二条“经营者采用财务或者其他手段进行贿赂以销售或者购买商品，构成犯罪的，依法追究刑事责任；不构成犯罪的，监督检查部门可以根据情节处以一万以上二十万以下的罚款，有违法所得的，予以没收”的规定，浦东新区市监局决定，行政处罚如下： 　　1.罚款100000.00元； 　　2.没收违法所得617768.74 元。 　　当事人如不服处罚决定，可在接到《处罚决定书》之日起六十日内，向上海市工商行政管理局或浦东新区人民政府申请行政复议，也可以在六个月内依法向浦东新区人民法院起诉。逾期不申请行政复议或者不向人民法院起诉又不履行行政处罚决定的，该机关可以依法申请人民法院强制执行。<p style="font-size: 16px;white-space: normal;line-height:
