医疗器械采购中，招试剂赠设备是否合法？

/></p></span></p><p><br  /></p></blockquote><p><br  /></p></section><section></section><section></section></section></section></section></section></section></section><p>近两年，一种“<strong>招试剂赠设备</strong>”的招标模式在政府采购医疗器械项目中快速流行。<span>所谓“招试剂赠设备”是指采购人（医院）公开招标体外诊断试剂（以下简称试剂），附加条件是“提供配套检验设备供使用”，有的还要求供应商“为医院提供实验室改造并承担费用”。</span>问题不单在招试剂时出现，一些大量使用专用耗材的采购人招标也要求（免费）提供设备，类似情况有愈演愈烈的趋势。</p><p><br  /></p><section data-role="outer" label="Powered by 365editor"><section data-role="outer" label="Powered by 365editor"><section data-tools-id="48908"><section powered-by="gulangu.us"><section><section><section><p><strong><span>这样的招标合法吗?</span></strong></p><p><br  /></p></section><section></section><section></section></section></section></section></section></section></section><p>政府采购“是指以合同方式<strong>有偿</strong>取得货物、工程和服务的行为”（《政府采购法》第二条），“有偿”即“不得免费”。<span>“采购人不得向供应商索要或者接受其给予的赠品、回扣或者与采购无关的其他商品、服务”（《政府采购法实施条例》第十一条），这是法律法规早有的明文规定。</span>采购人如此招标，违法是不言而喻的。招标试剂是旗号，非法索要赠品（设备）、回扣才是其主要目的。</p><p><br  /></p><section data-role="outer" label="Powered by 365editor"><section data-tools-id="48908"><section powered-by="gulangu.us"><section><section><section><p><strong><span>这是公平交易吗?</span></strong></p><p><strong><span><br  /></span></strong></p></section><section></section><section></section></section></section></section></section></section><p>看得出来，采购人研究过法规条文，推敲过的招标文件以“提供配套检验设备供使用”的文字，规避了“赠品”“免费”“回扣”等敏感用词，对设备所有权的归属也有意不提。业内人都心知肚明，设备不管是无偿赠送或者无偿租用，还有实验室改造费用，都属“赠品回扣”，是法规明令禁止的。</p><p><br  /></p><p>医院“用完试剂再回款”已是试剂回款多年的行规。这样，医院基本上不占用自己这部分流动资金就可以经营，说穿了，是借着试剂供应商的钱（融资）在经营；为追求利益更大化，现在设备也不买了让供应商“提供”（不说是赠送），不管算是赠送，或者算是分期付款的购买，反正售后服务和维修配件，医院既不操心也不掏钱，也全要供应商包了；医院不敢说让供应商送回扣，但是实验室的改造费用还要让供应商来承担，明明就是一笔回扣钱。</p><p><br  /></p><p>这样的医院真该想一想，这是公平交易吗？</p><p><br  /></p><section powered-by="gulangu.us"><section><section><section><p><strong><span>租赁是法定的采购选项</span></strong></p><p><br  /></p></section><section></section><section></section></section></section></section></section></section><p>有的医院确实没那么多钱买设备，那可以租设备呀。租赁是法定的政府采购选项之一（《政府采购法》第二条），通过政府采购的正规招标程序，购买试剂，租赁设备，租金由中标结果确定，按期支付，合法合规，公平公正，缺钱的问题也就解决了。这么好的正路子不走，却跟着学习“招试剂赠设备”的邪门歪道，实在是走错了路子！<br  /></p><p><br  /></p><section data-role="outer" label="Powered by 365editor"><section data-tools-id="48908"><section powered-by="gulangu.us"><section><section><section><p><span><strong>市场秩序受损，地方政府有责</strong></span></p><p><br  /></p></section><section></section><section></section></section></section></section></section></section><p>“赠设备”损害了政府采购“有偿取得”法定原则的严肃性；赠品回扣则破坏了采购价格和采购标的成本严格的对价关系，严重扰乱了市场的正常价格体系；既人为造成国有资产管理的漏洞，也为滋生腐败留下黑洞；部分医院受非法利益之驱使，忘记了采购人“应当维护国家利益和社会公共利益，公正廉洁，诚实守信”（《政府采购法实施条例》第十一条）的要求，让政府采购公平交易诚实信用的形象蒙羞，政府采购市场的正常秩序受到扰乱。<br  /></p><p><br  /></p><p>有些地方政府出于地方利益，明知其违法也给予放行或默许，显然是负有责任的。</p><p><br  /></p><section data-role="outer" label="Powered by 365editor"><section data-tools-id="48908"><section powered-by="gulangu.us"><section><section><section><p><strong><span>接受赠品回扣的法律责任</span></strong></p><p><strong><span><br  /></span></strong></p></section><section></section><section></section></section></section></section></section></section><p>采购人及其工作人员“在采购过程中接受贿赂或者获取其他不正当利益的”，或“依法追究刑事责任”，或“罚款”，或“没收违法所得”，或“行政处分”（《政府采购法》第七十二条）；还要区别情况或“终止采购”，或“中标无效”，或“撤销合同”，或“赔偿损失”（《政府采购法实施条例》第七十一条）。<br  /></p><p><br  /></p><p>10月1日起施行的《政府采购货物和服务招标投标管理办法》（财政部令第87号，以下简称“87号令”）则明确规定，采购人“向供应商索要或者接受其给予的赠品、回扣或者与采购无关的其他商品、服务”的，将“责令限期改正”“情节严重的，给予警告”，对直接负责的主管人员和其他直接责任人员“依法给予处分，并予以通报”“涉嫌犯罪的，移送司法机关处理”。</p><p><br  /></p><section data-role="outer" label="Powered by 365editor"><section data-tools-id="48908"><section powered-by="gulangu.us"><section><section><section><p><span><strong>杜绝赠品回扣的建议</strong></span></p><p><span><strong><br  /></strong></span></p></section><section></section><section></section></section></section></section></section></section><p>首先，地方政府应当摒弃地方非法利益，严格执法，对于含有赠品回扣的采购项目一律不予放行。<br  /></p><p><br  /></p><p>其次，采购文件应当依法写入“含有赠品回扣的投标（响应）文件为无效文件”“对零元价格或不标示价格的标的物均视为赠品回扣”“对明显低于其他投标人报价的，按照87号令第六十条的规定处理”。对于采购文件要求或者变相要求提供赠品回扣的，评审专家则应当以“采购文件内容违反国家强制性规定”而“停止评审”（《政府采购法实施条例》第四十一条）。</p><p><br  /></p><p>其三，对已经做了和正在做的“招试剂赠设备”项目，依照《政府采购法实施条例》第七十一条的规定，区别情况依法处理。</p><p><br  /></p><p>据闻，前段时间国家工商管理部门、卫计委等多部委进一步加强了医药领域的反腐部署，“捆绑耗材和配套设备销售等涉嫌商业贿赂不正当竞争行为”是查处的重点之一。希望借此机会能有效遏制和纠正“招试剂赠设备”等类似违法行为，以维护政府采购市场的正常秩序。</p><p><br  /></p></section></section></section></section></section></section><p><span>来源：政府采购信息
