/></p></section><section><span><br  /></span></section><section><span>《中华人民共和国政府采购法》（以下简称《政府采购法》）第十条规定，政府采购应当采购本国货物、工程和服务；《国务院办公厅关于促进医药产业健康发展的指导意见》（国办发〔2016〕11号）第十三条规定，国产药品和医疗器械能够满足要求的，政府采购项目原则上须采购国产产品，逐步提高公立医疗机构国产设备配置水平。</span></section><section><span><br  /></span></section><section><p><img /></p></section><section><span>（截图来源：广东省财政厅）</span><br  /></section><section><br  /></section><section><span>内容指出，在公立医疗机构购买大型医疗设备时，优先推荐首台套等具有自主知识产权的创新型医疗器械产品，以及在首台套产品满足相关条件的，享受小微企业一样的加分政策的答复意见。</span></section><section><span><br  /></span></section><section><span>2019年，根据《国家发展改革委、科技部、工业和信息化部、司法部、财政部、国资委、国家市场监督管理总局、知识产权局关于促进首台（套）重大技术装备示范应用的意见》（发改产业〔2018〕558号）第三十七条“健全优先使用创新产品的政府采购政策；</span></section><section><span>对首台套等创新产品采用首购、订购等方式采购，促进首台套产品研发和示范应用”的规定，财政部印发了相关文件，对给予创新产品优先、首购、订购等政策支持提出了明确要求。</span></section><section><span><br  /></span></section><section><span>内容指出，下一步多部门将对纳入《广东省首台（套）重大技术装备推广应用指导目录》的医疗专用设备，采用首购、订购等方式采购，促进创新产品的研发和示范应用，并进一步研究完善我省实施首购订购的具体措施。</span></section><section><span><br  /></span></section><section><strong><span>禁止指定供应商</span></strong></section><section><br  /></section><section><span>对于广东生产的大型医疗设备的省内市场占有率的答复意见指出：政府采购政策由国家制定、全国统一实施。</span></section><section><span><br  /></span></section><section><span>《中华人民共和国政府采购法实施条例》第六条规定财政部会同国务院有关部门制定政府采购政策，各部门、各地方不得自行制定政府采购政策，防止各部门、各地方通过政府采购政策造成地区或行业保护。</span></section><section><span><br  /></span></section><section><span>同时，《条例》第二十条规定，采购人或者采购代理机构有以特定行政区域或者特定行业的业绩、奖项作为加分条件或者中标、成交条件；对供应商采取不同的资格审查或者评审标准；</span></section><section><span><br  /></span></section><section><span>限定或者指定特定的专利、商标、品牌或者供应商；非法限定供应商的所有制形式、组织形式或者所在地的，属于以不合理的条件对供应商实行差别待遇或者歧视待遇。根据《政府采购法》第七十一条的规定，相关行为需要处以行政处罚。</span></section><section><span><br  /></span></section><section><span>在《政府采购进口产品管理办法》（财库〔2007〕119号）的规定。政府采购应当采购本国产品，采购人需要采购的产品在中国境内无法获取或者无法以合理的商业条件获取，以及法律法规另有规定确需采购进口产品的，实行审核管理。</span></section><section><span><br  /></span></section><section><span>将进一步规范进口产品核准管理等有关工作，提出从严核准政府采购进口产品的工作要求。</span></section><section><span><br  /></span></section><section><strong><span>进口器械将重点规范</span></strong></section><section><span><br  /></span></section><section><span>怎样规范进口采购？有哪些要求？</span></section><section><span><br  /></span></section><section><span>内容指出，将建立省级进口产品清单，由省卫生健康委牵头组织专家对医疗设备国内外同类产品相关参数逐条比对论证，对国内产品不能达到的参数制订进口产品清单，实行动态管理（满1年重新论证，期间如有国内产品达到要求，将被移出清单）；</span></section><section><span><br  /></span></section><section><span>省级医疗机构在2020年部门预算编制中，拟采购进口产品的，编制进口清单目录内项目的政府采购预算。</span></section><section><span><br  /></span></section><section><span>如果因信息不对称等原因，仍有满足需求的国内产品要求参与采购竞争的，不得对其加以限制，按照公平竞争原则实施采购。</span></section><section><span><br  /></span></section><section><span>另外是出台《广东省卫生健康委关于印发广东省2018-2020年乙类大型医用设备配置规划和技术评估标准（试行）的通知》（粤卫财务函〔2019〕28号），积极鼓励公立医疗器械使用单位优先配置国产自主品牌乙类大型医用设备，逐步提高国产医用设备配置水平。</span></section><section><span><br  /></span></section><section><span>广东省卫生健康委积极加大对国产自主品牌大型医用设备配置许可环节支持力度。</span></section><section><span><br  /></span></section><section><span>对于医疗器械使用单位申请大型医用设备配置许可，在实际操作中，明确市（县）级以下医疗机构首次配置大型医用设备的，以及市（县）级医疗机构配置第2台及以上的、地级市以上的医疗机构配置第3台以上的、明确用于特定专科使用的，原则上应选择国产设备。</span></section><section><span><br  /></span></section><section><span>同时简化配置国产大型医用设备的审批程序，优化审批服务，将乙类大型医用设备配置的许可审批时限由法定的20个工作日调整为8个工作日，落实“马上办、网上办”。据统计，国产自主品牌的产品占我省医疗器械使用单位配置的比例已达到约14%。</span></section><section><span><br  /></span></section><section><strong><span>进口清单外，需采购国产</span></strong></section><section><strong><span><br  /></span></strong></section><section><span>6月，国家卫健委财务司最新发布了国家卫生健康委员会2020年部门预算，其中综合公立医院2020年的预算数同比去年下降了41.8%。</span></section><section><span><br  /></span></section><section><span>事实上，综合公立医院财政拨款的减少，首先要削减的就是医疗设备配置的预算，而高性价比的国产医疗设备会更受青睐。</span></section><section><span><br  /></span></section><section><span>就在7月23日，国务院下发的2020年下半年深化医改工作任务文件中，就明确提出：落实政府对符合区域卫生规划的公立医院基本建设和设备购置等投入政策，但是严禁举债建设。</span></section><section><span><br  /></span></section><section><span>可以看出，在疫情常态化的阶段，财政在医疗方面的投入势必会集中在防疫领域，而常规医疗设备的投入将更大程度的考虑到性价比，这也为国产医疗设备进院提供更好的机会。</span></section><section><span><br  /></span></section><section><span>近几年全国对于支持国产的呼声达到了顶峰，作为长期被进口品牌垄断的医疗器械行业，也成为了国家推进国产产品的一个重点领域。各省在允许采购进口医疗产品方面加大限制，在国产产品能够达到同等要求的情况下，坚决优先采购国产。</span></section><section><span><br  /></span></section><section><span>本次广东的还明确提出：近期广东省财政厅将在充分调研及征求意见的基础上，进一步规范进口产品核准管理等有关工作，提出从严核准政府采购进口产品的工作要求。</span></section><section><span><br  /></span></section><section><span>广东省卫健委曾发布《关于 2019 年省级卫生健康机构进口产品清单的公示》，其中纳入2019年广东省省级卫生健康机构进口产品目录清单的医疗设备，共计132种，试剂73种。</span></section><section><span><br  /></span></section><section><p><img
