powered-by="gulangu"><p><br  /></p><section><span>此次，《基准》中各类违法行为依据社会危害性划定为A、B、C三个基础裁量档次。其中，“违法行为本身社会危害性严重的”对应A档，“违法行为本身社会危害性一般的”对应B档，“违法行为本身社会危害性轻微的”对应C档。</span></section></section><section powered-by="gulangu"><section><br  /></section><section><span>《基准》针对各类违法行为设定的基础裁量档，其对应的裁量幅度为依法从轻处罚的下限至从重处罚的上限。属于行政处罚法应当或可以减轻处罚情节的，可以跨越本《基准》规定的基础裁量档实施处罚。</span></section><p><br  /></p></section><p><p><img powered-by="gulangu"><p><br  /></p><section><span>其实，早在六月下旬，国家市场监督管理总局就发布了《防疫物资产品质量和市场秩序专项整治行动典型案件》。据官网披露，本次整治是按照党中央、国务院决策部署，要求各地市场监管部门全面排查防疫物资产品质量和市场秩序存在的隐患，全面整治生产、流通、消费中存在的突出问题。</span></section><p><br  /></p></section><section powered-by="gulangu"><p><br  /></p><section><span>在本次通报中，北京市延庆区市场监管局查处未经许可从事第三类医疗器械经营活动和经营未依法注册医疗器械案。涉案当事人未取得《医疗器械经营许可证》，销售及捐赠“冠状病毒核酸检测试剂盒”和“七种冠状病毒核酸检测试剂盒”共计95盒，货值共计93322.42元。<br  /><br  />违反了《医疗器械监督管理条例》第三十一条第一款和第四十条的规定。鉴于当事人及时召回“冠状病毒核酸检测试剂盒”65盒，召回比例较大，依法对当事人罚没合计约140.8万元。&nbsp;</span></section></section><section powered-by="gulangu"><section><br  /></section><section><span>回到今天的重点，北京市药监局发布的《基准》，对无证、无资质生产、销售体外诊断试剂的企业处力度最大。无证经营是药监部门不可容忍的行为和逾越的红线。有着“医疗器械行业母法”之称的《医疗器械监督管理条例》中表示：</span></section><p><br  /></p></section><section powered-by="gulangu"><ul><li><p><span>第八条：第一类医疗器械实行产品备案管理，第二类、第三类医疗器械实行产品注册管理。</span></p><p><br  /></p></li><li><p><span>第二十二条：从事第二类、第三类医疗器械生产的，生产企业应当向所在地省、自治区、直辖市人民政府食品药品监督管理部门申请生产许可并提交其符合本条例第二十条规定条件的证明资料以及所生产医疗器械的注册证。</span></p><p><br  /></p></li><li><p><span>第二十二条：从事第二类、第三类医疗器械生产的，生产企业应当向所在地省、自治区、直辖市人民政府食品药品监督管理部门申请生产许可并提交其符合本条例第二十条规定条件的证明资料以及所生产医疗器械的注册证。</span></p><p><br  /></p></li><li><p><span>第三十一条：从事第三类医疗器械经营的，经营企业应当向所在地设区的市级人民政府食品药品监督管理部门申请经营许可并提交其符合本条例第二十九条规定条件的证明资料。</span></p><p><br  /></p></li><li><p><span>第四十条：医疗器械经营企业、使用单位不得经营、使用未依法注册、无合格证明文件以及过期、失效、淘汰的医疗器械。</span></p></li></ul></section><section powered-by="gulangu"><section><br  /><span>一明确整治重点：对全市新冠肺炎病毒诊断试剂经营企业、使用单位和第三方检测机构开展了全面检查。<br  /><br  />在检查过程中明确了要求经营使用的医疗器械产品必须从取得医疗器械经营许可证、经营备案凭证、生产许可证企业购进，必须取得《医疗器械产品注册证》《医疗器械产品备案凭证》等相关证明文件；使用单位必须建立使用前质量检查制度，进货查验记录是否真实、完整、准确；经营单位必须落实《医疗器械经营管理规范》。</span></section><section><br  /></section><section><span>二是突出检查实效：市、区（县）、所三级联动，针对辖区内新冠肺炎病毒诊断试剂经营企业、医疗机构（社区医院）和检测中心开展全面监督检查。</span></section><p><br  /></p><p><span>此次专项工作有二个特点：</span></p><p><br  /></p></section><section
