src="image/20201014/bf5b3cf000a732644bb74ecf116deb71_4.png" /></p></section></section><section><br /></section><section><span>国药集团（广州）医疗器械有限公司，因与其他供应商恶意串通投标，被佛山市顺德区财政局处罚：</span></section><section><br /></section><section><span>（一）列入不良行为记录名单，在一年内禁止参加政府采购活动； </span></section><section><span><br /></span></section><section><span>（二）处以采购金额5‰的罚金，金额为：8650元（大写：人民币捌仟陆佰伍拾元整）。 </span></section><section><br /></section><section><span>并且此次处罚被纳入“政府采购严重违法失信行为记录”。</span></section><section><br /></section><section><span>企查查公开资料显示，国药集团（广州）医疗器械有限公司（以下简称国药广州器械）是中国医疗器械有限公司（国药器械）的下属孙公司。注册资金5000万元。</span></section><section><br /></section><section data-mpa-template="t" /></section><section><span>在以往的医疗设备恶意串通投标案件中，中小型企业占据多数。大型流通企业的下属公司相对较少。</span></section><section><br /></section><section><span>早前，广东省公安厅发布《2018年十大经济犯罪案件》，其中一个大案就是【深圳宁益科技公司等涉嫌串通投标系列案】。</span></section><section><br /></section><section><span>该案中，2018年5月，广东省公安厅组织深圳、珠海、韶关、广州、中山等地公安机关开展专题监测预警分析，发现多起公立医院医疗器械采购项目中的串通投标犯罪线索。</span></section><section><br /></section><section><span>成功打掉5个盘踞在深圳、中山等地公立医院医疗器械采购领域的串通投标犯罪团伙，同时切断1个转移涉腐资金的地下钱庄通道，共抓获犯罪嫌疑人33名，查实涉嫌串通投标项目45个，涉及全国8个省82家公司，涉案金额高达2.72亿元！</span></section><section><br /></section><section><span>医疗设备串通投标，在行业内可谓是屡禁不止。不过，历来是被查出来后予以行政处罚的多，被追究刑事责任的少。</span></section><section><br /></section><section><span>《招标投标法》、《政府采购法》中给予串通投标的投标人、招投标代理机构一般是企业及主管、直接负责人被罚款，没收违法所得，情节严重的取消其一年至二年内参与招标的资格，直至吊销营业执照和招标代理资格。</span></section><section><br /></section><section><span>但是《刑法》在“串通投标罪”中明确规定：</span></section><section><br /></section><section><span>投标人相互串通投标报价，损害招标人或者其他投标人利益，情节严重的，处三年以下有期徒刑或者拘役，并处或者单处罚金。</span></section><section><br /></section><section><span>何为情节严重呢？</span></section><section><br /></section><section data-mpa-template="t" mpa-paragraph-type="image"><section><p><img src="image/20201014/31e131dce13530cb9575b720a34eac2e_6.jpg" /></p></section></section><section><br /></section><section data-mpa-template="t" mpa-from-tpl="t"><section /></section></section></section></section></section><section><span>医疗器械采购的高额利益，驱使着在其招投标环节，围标串标频发。去年多地公安机关破获医疗设备串通投标大案，涉案金额高达数百万甚至是上千万。而设置“投标报名”环节是则是造成串通投标的重要推手。</span></section><section><br /></section><section><span>实际上目前在“招投标”的法律规定上是没有规定需要投标报名，即投标报名是没有法律法规依据的“招投标”操作习惯。但是按照以往惯例，进入全国各地区各级公共资源交易中心交易的工程建设招投标、政府采购、医疗设备采购等项目，交易流程中均存在“投标报名”环节。</span></section><section><br /></section><section><span>但是设置“投标报名”环节和报名期限，由此可能致使投标报名不充分，投标人获知招标信息较晚而错过了报名时间。同时，容易泄露潜在投标人名单，这也是容易导致串标、围标、劝阻其他投标人放弃投标等行为的发生重要原因！</span></section><section><br /></section><section><span>有业内人士指出，投标报名是没有法律法规依据的招标投标操作中的长期习惯做法，是串通投标的推手，也是泄露潜在投标人信息的手段，百害而无一益。</span></section><section data-mpa-template="t" mpa-from-tpl="t"><section><br /></section></section><section><span>去年国务院办公厅发布《国务院办公厅转发国家发展改革委关于 深化公共资源交易平台整合共享指导意见的通知》（国办函〔2019〕41号），通知明确提出：</span></section><section><br /></section><section><span>精简管理事项和环节。系统梳理公共资源交易流程，取消没有法律法规依据的投标报名、招标文件审查、原件核对等事项以及能够采用告知承诺制和事中事后监管解决的前置审批或审核环节。</span></section><section><br
